RESOLUTION NO. 95-085 I
A RESOLUTION OF THE CITY COUNCIL OF THE C
OF SEWARD, ALASKA, APPROVING AN AMENDMEN TO THE
EMPLOYMENT AGREEMENT WITH RONALD A. ARZINI,
PROVIDING FOR MR. GARZINI TO SERVE AS TERIM
CITY MANAGER, TERMINABLE ON 90 DAYS' OTlCE

WHEREAS, the City Manager contract between the Ciiand Tyler Jones expired on June
30, 1995; and /

WHEREAS, on April 24, 1995, the City Council adqt)ted Resolution No. 95-038, approving
an employment agreement with Ronald A Garzini ("Garzinj~) to provide city manager services to the
City beginning July 1,1995; and
WHEREAS, a lawsuit has been brought agairist the City, alleging that proceedings resulting
in the approval of the employment agreement with/Garzini violated the Alaska Open Meetings Act,
AS 44.62.310; and
WHEREAS, the City desires to cure,any alleged violation of the Open Meetings Act related
to the approval of the employment agreement with Garzini by conducting a substantial and public
reconsideration of issues related to the ~cruitment and selection of a new city manager; and

WHEREAS, while the City 96nducts a substantial and public reconsideration of issues related
to the recruitment and selection o~,a new city manager, and to secure for the City the services of an
interim city manager while thaUeconsideration is pending, the City and Garzini have negotiated
amendments to Garzini's employment agreement under which Garzini will serve as interim city
manager, terminable on 90 day's notice;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The amended employment agreement between the City of Seward and Ronald A.
Garzini, attached and incorporated herein by reference, to provide interim city manager services to
the City, terminable on 90 day's notice, is hereby APPROVED.
Section 2. This resolution shall take effect immediately upon its adoption.
FAILED TO PASS by the City Council of the city of Seward, Alaska, this 28th day of
August, 1995.
