HomeMy WebLinkAboutRes1986-102 . . . . - Sponsored by: City Manager CITY OF SEWARD, ALASKA RESOLUTION NO. 86-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, TO APPROVE NEGOTIATING WITH SOLE BIDDER FOR SPRING CREEK CORRECTIONAL FACILITY WASTEWATER TREATMENT PLANT WHEREAS. The City of Seward is funding the design and construction of the Wastewater Treatment Pl ant for the Spring Creek Correctional Facility from revenue derived from the sale of Certificates of Participation; and WHEREAS, occupied until the and accepted by the the prison facility cannot be started up and Wastewater Treatment Plant is started up, tested, permitting agencies; and WHEREAS, the project was properly advertised for competitive bids in accordance with City and State purchasing codes, and Northway Development, Inc. was the sole responsive bidder, except that its bid exceeded the budget; and WHEREAS, Northway Development, Inc. submitted an unsolicited proposal to reduce the cost by simplifying the design without changing the concept or scope of the project; and WHEREAS, the State of Alaska Department of Transportation and Public Facilities, in its role as Project Manager, based on advice from the State Attorney General, has determined that it would be allowable under state law and also under the Seward City Code to waive public bidding if found that the public interest would be best served; and WHEREAS, the State and City have determined, for reasons set forth in a Council memorandum dated November 24, 1986, that the risk resulting from delaying award of the contract and proceeding to a conventional owner-designed-and-then-bid contract are unacceptable, and the public interest would be best served by waiving competitive bidding and, instead, negotiating a contract with the sole bidder. NOW. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Seward City Council has determined that the public interest would be best served by waiving the requirement of Section 10-8 of the Seward City Code. . . .
