RESOLUTION NO. 95-092
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE SALE OF THE
400-AMP ELECTRICAL SYSTEM SERVICING THE SYNCROLIFT
DOCK TO SEWARD SHIP'S DRYDOCK AND AUTHORIZING THE
CITY TO SHARE EQUALLY IN THE TOTAL COST OF DEVELOPING
THE CURRENT SSD LEASE AND OPERATING AGREEMENTS
WHEREAS, two critical issues remain unresolved with respect to post-negotiation
discussions of the lease and operating agreements between the City and Seward Ship's Drydock
(SSD); and
WHEREAS, it is in the public interest to resolve these issues and to build a strong working
relationship between the City and SSD; and
WHEREAS, SSD wishes to purchase the 400-amp electrical system servicing the Syncrolift
Dock and constructed with Harbor funds, but objects to paying the price initially set by the Harbor;
and
WHEREAS, in order to accommodate the desire of S SD to purchase the electrical system
and protect the public's right to a reasonable return on its investment in the system, it is the
recommendation of the city administration that the system be offered to SSD for one-half the current
value since this will more than reimburse the Harbor for actual cash outlay for construction of the
electrical system; and
WHEREAS, the city administration further recommends that the City agree to share equally
in the cost of developing the ground lease and the operating and maintenance agreement in order to
bring resolution to this issue and in keeping with the Council's original directive to negotiate an
agreement of mutual benefit to the City and SSD;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to sell the 400-amp electrical system servicing the
Syncrolift Dock to Seward Ship's Drydock for a total price of $11, 111.00.
Section 2. The City Manager is further authorized to reduce the charge to Seward Ship's
Drydock for lease preparation by 50% making the total charge to SSD for preparation of the lease
and maintenance and operating agreement $11,850.00.

Section 3. This resolution shall take effect immediately upon its adoption.
