CITY OF SEWARD, ALASKA
RESOLUTION NO. 87-084
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE AWARD OF A PURCHASE ORDER
TO HARLEY TRUCKING COMPANY FOR PAVING THE SMIC CARGO
DOCK WITHOUT FULL UTILIZATION OF CITY BID PROCEDURES
WHEREAS, on August 3, 1987, a crane owned and operated
by Afognak Logging Company drove onto the SMIC cargo dock
with steel pads and ice cleats and caused extensive damage
to the concrete dock; and
WHEREAS, Afognak Logging did not agree to repair or
propose a method of repairing the damage upon being request-
ed to do so by the city; and
WHEREAS, Scott Yaskell, the representative of Afognak
Logging Company's insurance company, Industrial Indemnity,
visited the site and contacted the city on August 20, 1987;
and
WHEREAS, Harley Trucking Company was paving at the SMIC
On August 20 and was scheduled to demobilize and leave
Seward on August 21, and no other capability existed in
Seward to overlay the dock with asphalt; and
WHEREAS, Scott Yaskell did not object to the city
directing Harley Trucking Company to repair the dock by
overlaying it with 2 inches of asphalt pavement; and
WHEREAS, an asphalt overlay is considered an appropri-
ate and cost effective means to repair the damage;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. It is determined that delay incident to
competitive bidding of the paving of the SMIC cargo dock was
unacceptable and that the needed service could only be
furnished by a single dealer; therefore, the public interest
would best be served by not requiring competitive bidding
under Section 10-8 of the Seward City Code.
Section 2. The city manager is hereby authorized to
issue a purchase order to Harley Trucking Company in an
amount not to exceed $12,000 to overlay the SMIC cargo dock
with asphalt.

Section 3. This resolution shall take effect immedi-
ately upon its adoption.
