RESOLUTION NO. 95-096
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, RATIFYING AND CONFIRMING THE
EMPLOYMENT AGREEMENT WITH RONALD A. GARZINI AS
CITY MANAGER APPROVED BY RESOLUTION NO. 95-038
WHEREAS, on April 24, 1995, the City Council adopted Resolution No. 95-038, approving
an employment agreement with Ronald A. Garzini ("Garzini") to provide city manager services to
the City beginning July 1, 1995; and
WHEREAS, a lawsuit has been brought against the City alleging that proceedings resulting
in the approval of the employment agreement with Garzini violated the Alaska Open Meetings Act,
AS 44.62.310; and
WHEREAS, the City Council has conducted a substantial and public reconsideration of
issues related to the recruitment and selection of a new city manager, including public reconsideration
of this subject at its July 24, 1995 and August 28, 1995 regular meetings, and a public interview of
Garzini at its August 7, 1995 special meeting; and
WHEREAS, each of the July 24, August 7 and August 28, 1995 meetings ofthe City Council
was duly noticed to the public, and at each of these meetings members of the public were given an
opportunity to address the City Council concerning the recruitment and selection of a city manager;
and
WHEREAS, based upon this substantial and public reconsideration of issues related to the
recruitment and selection of a new city manager, the City Council finds that it is in the best interest
of the City to hire Garzini as city manager under the terms of the employment agreement approved
by Resolution No. 95-038 and to ratifY and confirm that agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Based upon the substantial and public reconsideration of issues related to the
recruitment and selection ofa city manager, as described above, Resolution No. 95-038 of the City
of Seward, authorizing an employment agreement between the City of Seward and Ronald A. Garzini
as city manager, is in all respects ratified and confirmed.
Section 2. This resolution shall take effect immediately upon its adoption.
