RESOLUTION NO. 88-005
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, SETTING FEES FOR THE SEWARD MUNICIPAL
SMALL BOAT HARBOR AND RESCINDING ALL PRIOR RESOLUTIONS
IN CONFLICT HEREWITH
WHEREAS, Section 5-80.1 of the Seward City Code pro-
vides that fees for the use of the Small Boat Harbor are to
be set by resolution of the City Council; and
WHEREAS, the Harbormaster of the city of Seward has
reviewed the current rates charged for moorage in the Small
Boat Harbor; and
WHEREAS, the Harbormaster has made certain specific
recommendations to modify charges for moorage, yard storage,
and boat lift fees to more accurately reflect the actual
cost of providing those services; and
WHEREAS, it is in the public interest to charge users
of the Small Boat Harbor for services at a rate reasonably
calculated to reflect costs to the city for operation and
maintenance of the Harbor;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. Fees for the use of the Seward Municipal
Small Boat Harbor shall be set as follows:
I. MOORAGE FEES:
A. Moorage Fees, Annual:
1. The annual moorage fee for preferential
moorage privileges shall be on the declining block method
based on the length of the float assigned or the overall
length of the vessel (including all hull attachments, such
as bowsprits, davits, dinghies, etc.), whichever is longer.
The rate structure is:
Vessels to 30'
31' to 40'
41' and up
- charged at $20.30 per foot per year;
- charged at $19.50 per foot per year;
- charged at $18.62 per foot per year.
2. The annual moorage fee for transient moorage
privileges shall be the same rate charged for preferential
moorage.

3. The six-month rate for either preferential or
transient moorage privileges shall be sixty percent (60%) of
the applicable annual rate.
4. All moorage privilege fees shall be paid when
due and in advance.

II. UPLAND STORAGE:
Upland storage of boats or boats on trailers or
cradles shall be at the rate of Fifty-four and 11/l00ths
Dollars ($54.11) per boat, trailer or cradle per month.
III. BOAT LIFT CHARGES:
A. The following charges shall be made for use of the
boat lift facility:

minutes, the fee shall be One Hundred Fifteen and 45/100ths
Dollars ($115.45), plus Ten Dollars ($10.00) for each six
minute increment or portion thereof in excess of seventy-two
(72) minutes.
B. City personnel only shall operate the boat lift.
C. Vessel owners or agents of any owner desiring to
have vessels lifted out of or placed in the water shall sign
an application and make payment of the estimated charges
before the work is done.
D. No person shall remain on any vessel while it is
being removed from or placed in the water.
IV. GRID RENTAL CHARGES:
A. Grid rental rates shall be as follows:

B. The Harbormaster shall issue written permission
for use of the grid and no boat shall be moored onto the
grid until such permission has been granted. The grid use
shall be on a first come, first serve, basis.
V. SERVICE CHARGE FOR USE OF CITY DOCK FACILITIES:
A. A service charge is the charge assessed against
vessels, their owners, agents or operators, which load or
discharge cargo at the City Dock, for performing one or more
of the following services (subject to Section B-F, below):
1. Providing terminal facilities;
2. Arranging berth for vessel;
3. Arranging terminal space for cargo;
4. Lighting terminal.
B. Service charges do not include any freight
handling, loading or unloading operations, nor any other
labor than provision of the services.
C. Service charges are not assessable on raw fish
discharged for the purpose of processing in a processing
facility located within the city of Seward.
D. Service charges shall not apply to the loading and
unloading or fishing gear or equipment or supplies connected
with commercial fishing.
E. The city of Seward reserves the right and privi-
lege to waive service charges at its discretion when it
appears to be in the best interest of the city to do so.
F. Service charge rates apply to cargo loading from
or to vessels except as otherwise provided. Rates are per
2,000 pounds or 1,000 board feet as follows:

VI. LABOR AND SERVICE CHARGES:
A. Service and labor performed by the Harbormaster or
any city employee working in the Harbor shall be charged at
the rate of one and one-half the hourly wage rate (including
fringe benefits, overtime and call-out pay) paid to the city
employee by the city.
B. Pumping of boats which are in danger of sinking
shall be charged at a rate of Ten and 30/l00ths Dollars
($10.30) per hour, plus any applicable labor costs as
determined in Paragraph "A" of this Section.
C. All materials or city supplies, including mooring
lines, shall be charged at their cost to the city.
D. Towing of boats shall be charged

C. Miscellaneous Charges shall be assessed in accor-
dance with Attachment "A" incorporated herein by reference.
Section 4. All previously approved resolutions in
conflict herewith are hereby rescinded.
Section 5. This resolution shall take effect immedi-
ately upon its adoption.
