CITY OF SEWARD, ALASKA
RESOLUTION NO. 88-017
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, ACCEPTING DEFERRAL TO THE CITY FOR
SAFETY INSPECTIONS AND ENFORCEMENT ACTIVITIES
WHEREAS, AS 18.70.090 and 13 AAC 50.075 permits the
state fire marshall to defer to local authorities fire
safety inspection and enforcement activities upon determin-
ing that the municipality has the expertise to conduct fire
safety inspections and to enforce state fire safety regu-
lations; and
WHEREAS, the state fire marshall due to severe budget
reductions has eliminated all state fire safety inspections,
except hospitals and schools; and
WHEREAS, it is in the public interest that Seward
continue to have a quality fire safety inspection program to
insure the health and welfare of its residents and visitors;
and
WHEREAS, the city of Seward has the expertise to
conduct fire safety inspections of all commercial, indus-
trial, institutional, public, and multi-family premises; and
WHEREAS, the state fire marshall desires to defer to
the city of Seward fire safety inspection and enforcement
activities and has agreed to assist the city with
inspections, provide technical assistance and training, and
assume the costs of prosecution of those cases not resolved
by inspection notices and citations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The city of Seward does hereby accept
deferral of fire safety inspection and enforcement activ-
ities from the state fire marshall pursuant to AS 18.70.090
and 13 AAC 50.075.
Section 2. This resolution shall take effect immedi-
ately upon its adoption.
