CITY OF SEWARD, ALASKA
RESOLUTION NO. 88-031
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROPRIATING FUNDS FOR THE PURPOSE
OF REFUNDING EPA GRANT FUNDS
WHEREAS, between the period April 25, 1975, and May 16,
1984, the city of Seward received three grants from the U.
S. Environmental Protection Agency (EPA) for the purpose of
designing and constructing sewer interceptors, force main,
pump stations, treatment lagoon, outfall lines and control
building; and
WHEREAS, the city of Seward claimed total costs for the
project of $7,206,099, for which EPA disbursed to the city
$5,404,575; and
WHEREAS, EPA has conducted an audit of the project and
has disallowed $90,796 in claimed project costs; and
WHEREAS, the city is appealing the EPA determination on
$58,804 of the disallowed costs; and
WHEREAS, the city does not question the EPA determina-
tion on $31,992 of the disallowed costs; and
WHEREAS, the Alaska Department of Environmental Conser-
vation owes the city approximately $81,000 from an ADEC
grant for the project which more than offsets the maximum
refund due EPA of $68,098;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The sum of $70,000 is hereby appropriated
from the Water/Sewer Fund Fund Balance Account No. 701-000-
271-00-00 to the FY 1988 Water/Sewer budget for the purpose
of refunding ineligible costs plus interest due the U. S.
Environmental Protection Agency for Construction Grant No.
C-02-0051, Segments -01, -02, and -03.
Section 2. The city manager is authorized to remit
payment to EPA of those amounts not in dispute, along with
any remaining amounts still due EPA following a final
determination on the city's appeal to the Regional Adminis-
trator, not to exceed $70,000.
Section 3. This resolution shall take effect immedi-
ately upon its adoption.
