Sponsored by: Schaefermeyer CITY OF SEWARD, ALASKA RESOLUTION NO. 88-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AWARDING A CONTRACT FOR GRAVEL REMOVAL AND MAINTENANCE AT FOURTH OF JULY CREEK WHEREAS, in 1983, the city constructed a dike along the southwest bank of the Fourth of July Creek to protect the Seward Marine Industrial Center and the Spring Creek Correc- tional Center, and since that time the channel behind the dike has risen due to gravel deposited during spring runoff and especially during the October 1986 flood; and WHEREAS, the shift of the channel threatens the dike works and maintenance is required to provide removal of gravel deposited; and WHEREAS, by Request for Proposal posted January 20, 1988, the city of Seward sought proposals from interested persons to provide for the gravel removal this summer and also on a multi-year basis with the expectation that the city would acquire title to the lands underlying the Fourth of July Creek from the Kenai Peninsula Borough; and WHEREAS, the city has applied for transfer of ownership of the lands underlying the Fourth of July Creek from the Kenai Peninsula Borough, and the city has obtained a Right of Entry Permit from the Kenai Peninsula Borough for a period of 180 days from April 8, 1988, to conduct emergency flood control measures; and WHEREAS, only one proposal was submitted, that of Afognak Logging, a di vi sion of Kodiak Lumber Limited, and the proposer is willing to enter into the interim mainte- nance agreement only upon assurance by the city that it will, in good faith, seek to conclude a long-term agreement for the removal of gravel and storage of gravel on city lands near the Creek; and WHEREAS, the city administration has recommended award of the contract to Afognak Logging; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Council finds it in the public interest to award the contract to Afognak Logging without full utilization of the bid procedures set forth in city of Seward Code in that adequate notice of the contract was -1- . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 88-051 given, contractors were invited to propose, and the work constitutes emergency flood control measures which need to be done in the summer months before normal heavy rainfall in the early winter. Section 2. The contract in substantially the form attached to the City Engineer's recommendation is hereby awarded to Afognak Logging, a division of Kodiak Lumber Limited. Section 3. The City Manager is directed to negotiate with Afognak Logging for a long-term maintenance agreement and lease as contemplated by the Request for Proposals and Afognak's proposal. Section 4. This resolution shall take effect immedi- ately upon its adoption.
