I I Sponsored by: Janke CITY OF SEWARD, ALASKA NON-CODE ORDINANCE 2000-16 A NON-CODE ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROPRIATING FUNDS TO MAKE EXPENDI- TURES TO INFLUENCE THE OUTCOME OF AN ELECTION CONCERN- ING A BALLOT PROPOSITION OR QUESTION FOR THE SALE OF THE ELECTRIC UTILITY WHEREAS, the City of Seward currently owns and operates an electric utility; and WHEREAS, because of industry changes affecting the operation and economies of electric utilities throughout the United States and Alaska, it appears timely for the City Council to consider the prospect of selling the City's electric utility; and WHEREAS, Section 13.4 of the City Charter provides that "The council may sell, lease or otherwise dispose of a municipal utility or of property and interest in property used or useful in the operation of a utility only after a proposition to do so is approved by three-fifths of the electors of the city voting on the proposition;" and WHEREAS, by Resolution 2000-092, the City Council approved placing the ballot proposition to approve the concept of sale of the electric utility on the ballot for a special municipal election to be held November 7,2000; and WHEREAS, following approval by the voters to sell the electric utility, an actual sale will need City Council approval and such approval will be subject to referendum vote; and WHEREAS, AS. 15.13.145 provides that a municipality may not use public money "to influence the outcome of an election concerning a ballot proposition or question" (a phrase used in AS. 15.13.145) unless the funds have been specifically appropriated for that purpose by municipal ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Council hereby appropriates and authorizes for expenditure $2,500 for from the Electric Enterprise Fund Retained Earnings, account no. 501-0000-3050 to the Electric Enterprise Fund General Operating, Misc. Expense, account no. 501-5400-5790, for the purpose "to influence the outcome of an election concerning a ballot proposition or question" (a phrase used in AS. 15.13.145) and to support the concept of the sale of the electric utility. The City Council CITY OF SEWARD, ALASKA NON-CODE ORDINANCE NO. 2000-16 further directs and authorizes the City Manager and other City officers, officials, and employees, as may be appropriate, to complete and file all necessary reports, forms, and notices relating to election related expenditures under AS 15.13 or as may otherwise be required by law. Section 2. This ordinance shall take effect ten (10) days following enactment. ENACTED BY The City Council of the City of Seward, Alaska, this 25 day of September, 2000.
