CITY OF SEWARD, ALASKA
RESOLUTION NO. 88-098
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING ENCROACHMENT INTO THE
PUBLIC RIGHT OF WAY BY THE NEW SEWARD HOTEL
WHEREAS, Brad Snowden, dba New Seward Hotel, is con-
structing an addition to the New Seward Hotel which will be
in keeping with the architectural style of early Alaskan
buildings; and
WHEREAS, the design requires that second story bay
windows be constructed which will encroach approximately two
feet over the public right of way; and
WHEREAS, this encroachment will not affect the future
use of the right of way or constitute any hazard to users of
the right of way or sidewalk therein; and
WHEREAS, Section 19.1 of the Seward City Code only
addresses permitting of roofs and canopies over the public
rights of way;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The city manager is hereby authorized to
issue a permit to Brad Snowden, dba New Seward Hotel, for
construction of two second story bay windows which will
encroach approximately two feet over the public right of way
fronting the hotel.
Section 2. Said permit shall remain in effect for the
life of the structure, or until such time as the structure
may be remodeled for a cost exceeding fifty percent (50%) of
the value of the structure, or until the structure is
replaced.
Section 3. This resolution shall take effect immedi-
ately upon its adoption.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
