CITY OF SEWARD, ALASKA
RESOLUTION NO. 89-026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE AWARD OF A
NEGOTIATED CONTRACT FOR SPRING CREEK CORRECTIONAL
CENTER WATER SYSTEM IMPROVEMENTS
vJHEREAS, the Spring Creek Correctional Center experi-
ences severe water pressure fluctuations that may damage
equipment and generate false fire alarm signals; and
WHEREAS, this condition can be corrected by the instal-
lation of a pump control valve in the water system; and
WHEREAS, the city advertised for bids to accomplish
this work; and
WHEREAS, there was no response to the advertised
request for bids; and
WHEREAS, there are no local contractors who are qual-
ified, available or have otherwise demonstrated an interest
in bidding on this project; and
WHEREAS, the city has subsequently negotiated a con-
tract with S. R. Swett and Sons Construction to accomplish
this work; and

vlliEREAS, Title 6 of the Seward City Code authorizes the
award of a contract without competitive bidding if such
award is found to be in the public interest;
NOt-I, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SE\VARD, ALASKA, that:
Section 1. It is in the public interest to waive
formal bid procedures and award a negotiated contract for
the completion of water system improvements at the Spring
Creek Correctional Center.
Section 2. The City Manager is hereby authorized to
award a contract to S. R. Swett and Sons Construction in the
amount of $15,281.90.

RESOLUTION NO. 89-026
Section 3. The City Manager is further authorized to
establish a project account totalling $16,781.90, to include
a contingency amount of $1,500, for completion of the water
system improvements cited above.
Section 4. This resolution shall take effect immedi-
ately upon its adoption.

SEWARD, ALASKA, this 28th day of March 19 89 .
