CITY OF SEWARD, ALASKA
ORDINANCE 2000-017
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE, 8.20, VEHICLES FOR HIRE,
TO NO LONGER REQUIRE VEHICLES TO BE INSPECTED BY THE CITY
WHEREAS, the City of Seward Code regulates vehicles for hire; and
WHEREAS, there are extensive city regulations in place that a person must adhere to prior
to the City issuing a vehicle for hire permit; and
WHEREAS, one ofthese regulations requires "proof of inspection ofthe vehicle by the City
certifying that the vehicle meets city safety standards;" and
WHEREAS, this regulation should be eliminated because the City does not have adequate
personnel or equipment to perform these inspections, and the City does not wish to expose itself to
potential liability for failure to properly inspect; and
WHEREAS, city and state laws already require all vehicles to be maintained in a safe
manner; and
WHEREAS, current safety laws allow City of Seward Police and Alaska State Troopers to
issue citations for operating poorly maintained or unsafe vehicles; and
WHEREAS, the adoption of this ordinance does not restrict the City Manager's ability to
continue to adopt regulations enforcing safety standards and promulgating other rules and
regulations which assure that vehicles for hire are maintained and operated in a safe manner;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Seward City Code Title 8 is amended as follows:

8.20.025
Permit application.
A. An application for a permit shall be made to the city clerk on a form approved by
the city manager and shall be accompanied by:
1. the fee specified in S 8.20.030;
2. proof of insurance for the vehicle as required by S 8.20.045;
3. a complete list of the name, address and telephone number of every person
who shall have a financial or proprietary interest in the permit;
4. proofthat the applicant is at least eighteen years of age;
5. the specific location of the establishments to be served by a contract
service.~

B. An application for a vehicle for hire permit shall be granted by the clerk if the
applicant complies with subsection A. of this section. (Ord. 530, 1985; Ord. 592, 1987; Ord.
610, 1988; Ord. 94-40)
8.20.040 Number of vehicles operated per permit.
A. Only one vehicle, which shall be designated on the permit application, may be
operated pursuant to that permit.
B. Upon application to the city clerk and a demonstration of need, and ifthe
applicant has met the requirements set forth in Section 8.20.025 A., operation of a substitute
vehicle shall be authorized for a period of time not to exceed seventy-two hours, and the clerk
shall issue a notice of substitution. No person may operate a substitute vehicle under this section
unless the notice of substitution is carried in that vehicle at all times. An operator of a vehicle for
hire shall display the notice of substitution upon request to a police officer.

Section 2. This ordinance shall take effect ten days following its enactment.
ENACTED by the City Council of the City of Seward, Alaska, this 6 day of November,
2000.
