RESOLUTION NO. 86-6
A RESOLUTION OF THE CI'lY COUNCIL OF THE CI'lY OF
SE.WARD, fll.SKA, APPROVING THE SAlE OF GRAVEL TO SAMWHAN AMERICA
CORPORATION WITHOUT UTILIZATION OF THE BIDDING PROCEDURES
\mEREAS, the City of Seward has a stockpile of gravel adjacent
to Spring Creek within the Marine Industrial Center; and
WHEREAS, Samvhan Arrerica Corporation, the contractor for the
State of Alaska's Spring Creek Correctional Center, is in need of
acquiring approximately 150,000 cubic yards of gravel; and
\JHEREAS, the gravel stockpile is nearly adjacent to the
correctional facility site and SamWhan has requested to purchase 150,000
cubic yards of gravel from the City; and
WHEREAS, the City Council finds it in the public interest to
sell the gravel to Samvhan Arrerica Corporation; and
WHEREAS, sale of supplies, materials, equipment or contrac-
tual service to another unit of government at a price determined to be
below that obtainable from private dealers are exempt from the bidding
procedures set forth in Section 10-8 of the City Code;
NCM, THEREFORE, BE IT RESOLVED BY THE CI'lY COUNCIL OF THE CI'lY
OF SE'WARD, fll.SKA, that:
Section 1. The City Manager is hereby authorized to sell
approximately 150,000 cubic yards of gravel from the Spring Creek
stockpile for Two Dollars ($2.00) per cubic yard to Samvhan America
Corporation for use in constructing the Spring Creek Correctional
Center.
Section 2. This resolution shall take effect inmediately upon
its adoption.
