RECOMMENDING THAT THE SEWARD URBAN DISTRICT ZONING CODE BE AMENDED TO DEFINE AND REGULATE BED AND BREAKFAST HOME OCCUPATIONS WHEREAS. The Seward Advisory Planning and Zoning Commission is recommending the adoption of amendments to the Seward Urban District Zoning Code relative to Bed and Breakfast home occupations; and WHEREAS. the Seward Advisory Planning and Zoning Commission considered the proposed amendments at a work session on February 18. 1986; and WHEREAS. the Seward City Council amendments at their regul ar meeting of February Seward Advisory Pl anning and Zoning Commission on the proposed amendments; and cons ide red the proposed 24. 1986. and directed the to hold a public hearing WHEREAS. the Seward Advisory Planning and Zoning Commission held a publ ic hearing on the proposed amendments at their March 5. 1986 meeting. and have submitted their recommendations to the City Council; and WHEREAS. The City Council has considered the publ ic hearing and recommendations of the Seward Advisory Pl anning and Zoning Commission and finds that the amendment of the Seward Urban District Zoning Code to define and regul ate Bed and Breakfast home occupations is necessary in order to provide for the public health. safety and welfare; NOW. THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD. ALASKA. that: Section 1. The Kenai Peninsula Borough Assembly is requested to amend the Seward Urban District Zoning Code to define and regulate Bed and Breakfast home occupations by enacting the amendments incorporated in Attachment "A" to this Resolution. Section 2. This Resolution shall take effect immediately upon its adoption. . . . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 86-21 ATTACHMENT "A" Amend Chapter 21.78 of the Seward Urban District Zoning Code as follows: Section 21.78.030. Definitions Add new definition: Bed and Breakfast means a home occupa- tion in which the owner-occupant rents out a single guest room to a traveler on a short-term basis. Add a new Section 21.78.650. Home Occupations as follows: Section 21.78.651. Bed and Breakfast. Notwithstanding the provi- sions of any other section of this chapter, Bed and Breakfast use shall be allowed by administrative permit in the following districts: RR, R-1, R-2, and R-3 if the following requirements are met: a. The use follows the guidelines set forth as a home occupation; b. The operation will be limited to an owner-occupied dwelling with that dwelling being the owner's principal place of residence; c. No more than one bedroom will be utilized; d. One off-street parking space is to be provided for the Bed and Breakfast room in addition to those required for the residential dwelling; e. Use is contingent upon approval by the Fire Chief; f. No cooking or cooking facilities are permitted in the guest room; g. The length of stay shall not exceed seven (7) consecutive days; and h.
