HomeMy WebLinkAboutRes1995-127 , It It Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 95-127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING LEASE 91-070 AND AN EASEMENT WITH SEWARD MARINE SERVICES, INC., ON PORTIONS OF ATS 174 AND USS 1806 WHEREAS, the City and Seward Marine Services, Inc., granted mutual easements to one another for road and dock purposes in 1980 through an Easement agreement recorded in Book 21, beginning on Page 182, in the Seward Recording District; and WHEREAS, in 1991, the City leased to Seward Marine Services, Inc., two ATS 174 tideland parcels through a long term lease (No. 91-070) and recorded by Lease Memorandum in Book 63, beginning at Page 206, in the Seward Recording District; WHEREAS, Seward Marine Services, Inc., desires to transfer ownership of the property associated with Lease No. 9l-070 and above referenced Easement to Wards Cove Packing Company; and WHEREAS, as a condition of the purchase, transfer and assignment, Wards Cove Packing Company, Seward Marine Services, Inc., and the City have negotiated modifications to the Easement to include mutual indemnification, providing for public utilities within the road, increasing the scope of allowed uses of the tidelands and including certain groundwater sources needed by the City for the Alaska SeaLife Center project; and WHEREAS, the proposed lease amendment removes the development requirement, clarifies the lessee's responsibility regarding spills of hazardous substances, and modifies the size of the north lease parcel; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to execute Lease Amendment No.2 to Lease No. 91-070 between the City of Seward and Seward Marine Services, Inc., attached to and incorporated herein by reference. Section 2. The City Manager is further authorized to execute a revised mutual Easement Agreement, attached to and incorporated herein by reference, allowing Seward Marine Services, Inc., the use of a portion of A TS 174, and the City of Seward the use of a portion of USS 1806. CITY OF SEWARD, ALASKA RESOLUTION NO. 95-127 Section 3. This resolution shall take effect thirty (30) days after its passage and posting as required by law..
