RESOLUTION NO. 82-63
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, IN OPPOSITION TO KENAI PENINSULA BOROUGH ORDINANCE NO. 82-57,
EXEMPTING HOME ENERGY SOURCES FROM SALES TAX
WHEREAS, the Kenai Peninsula Borough Assembly has introduced
Ordinance No. 82-57, amending Chapter 5.16 of the Kenai Peninsula Borough
Code of Ordinances, in order to exempt all home energy sources from sales
tax; and
WHBREAS, any exemption from sales tax passed by the Kenai
Peninsula Borough Assembly, by State law may affect.similar sources from
any and all sales taxes enacted by cities within the Borough, including
the City of Seward; and
WHEREAS, the Kenai Peninsula Borough Assembly should refrain,
as a matter of policy, from taking any action which might drastically af-
fect the finances of the cities within the Borough without first obtaining
the concurrence of those cities so affected; and
WHEREAS, no data has been developed or provided to the cities of
the Borough as to the effect this exemption would have on the finances of
said cities; and
WHEREAS, loss of sales tax revenues due to an exemption of home
energy sources such as oil, gas, electricity, coal or wood could result in
a lowering of services extended to city residents; an increase in the rate
of sales tax on food, clothing and other essentials sold to the citizens of
the cities; or an increase in the mill levy on real property within the cities;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, that:
Section 1. The Seward City Council opposes further Kenai Peninsula
Borough Assembly action on Ordinance No. 82-57 until such time as factual
data pertaining to the impact this action would have had in recent years, by
quarter, beginning Fiscal Year 1979 and extending through Fiscal Year 1982,
is compiled and made available to the cities and citizens within the Kenai
Peninsula Borough.

Section 2. This resolution shall take effect immediately upon its
