CITY OF SEWARD, ALASKA RESOLUTION NO. 84-114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, ESTABLISHING CITY LEASE PROPOSAL PROCEDURES WHEREAS, the City of Seward, Alaska has property available for long term lease to prospective industries and businesses; NOlo', THEREFORE, BE IT RESOTNED BY THE CITY GOUNCIL OF THE CITY OF SEWARD, ALASKA, th~t: Section 1. City of Seward Resc1ution No. 84-10, dated February 27, 1984, is hereby rescinded and replaced by thi~ rpsolution. Section 2. The following lease proposal procedures are adopted and shall apply to all City-owned lands to be leased: A. Prosper.tive Lessee shall submit a written develop- ment plan, with drawings, to the City Manager for any parcel of land to be considered for leasing. The development plan shall state the date that development will commence and the date on which the development will be complete. B. The City Council shall record the filing of the development plan and proposal to lease, but shall not be required to approve or reject any proposal until the Council meeting next following that on which the information was filed. C. At the time Council directs the City Manager to proceed with the lease negotiation, the prospective Lessee shall place a cash deposit in an amount equal to one-half the first year's lease payment as estimated by the City staff. Said deposit shall be con- sidered a performance bond, and if the lease negotiation is not dili- gently pursued and completed by the prospective Lessee, the deposit shall be retained by the City of Seward as liquidating damages. D. If the proposed lease is approved, Lessee shall, within ten (10) calendar days of the effective date of the resolution authorizing the lease, pay the first year's lease in full and sign all lease papers. At this time, all costs incurred by the City for ap- praisals, preparation of the lease papers and any and all incidental costs thereof shall be deducted from deposit monies and any remaining funds shall be returned to the Lessee. In the event Council rejects the proposal or fails to approve the lease within 45 days of completion of negotiations, the total deposit shall be returned to the prospective Lessee. If the City Manager and prospective Lessee are unable to reach agreement on lease terms, then the deposit shall be returned to the Lessee after deduction by the City for the cost of all appraisals, preparation of lease documents, and other incidental costs to the City. -1- . . . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 84-114 E. Council may waive all or any part of these require- ments as it deems necessary to ensure successful lease negotiations. Section 3. This resolution shall take effect immediately upon its adoption.
