CITY OF SEWARD, ALASKA
RESOLUTION NO. 85-50
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING DISPOSAL, AT LESS THAN FAIR MARKET
VALUE, OF TWO BUILDINGS TO THE DEPARTMENT OF THE ARMY,
CORPS OF ENGINEERS, ACTING FOR THE U.S. AIR FORCE
WHEREAS, on or about September 28, 1983, the State of Alaska,
by operation of law, conveyed to the City of Seward all its right, title
and interest in and to Lots 1,2, and 3, Tract A, U.S. Survey 242,
commonly known as the Army and Air Force Recreation Camp; and
WHEREAS, as part of that property, two buildings were included
and are described as Building No. 1 (Army-Air Force Mess Hall) and an
unnumbered 20' by 40' quonset hut; and
WHEREAS, the Department of the Army, Corps of Engineers,
acting for the U.S. Air Force, does hold a lease on said property and
does utilize the buildings as part of the Air Force Recreation Camp; and
WHEREAS, certain federal Acts
expenditures that may be committed to
and/or repairs of rented buildings; and
severly restrict the monetary
the alteration, improvements
WHEREAS, the City of Seward has no present or anticipated
needs for said buildings, and does wish to encourage the upgrading of
these buildings; and
WHEREAS, the City Council of the City of Seward finds it in
the public interest as a show of good faith for the upgrade of these
facilities to dispose of Building No. 1 and a 20' by 40' unnumbered
quonset hut to the Department of the Army, Corps of Engineers, at less
than fair market value;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to execute the
attached Quitclaim Deed which is incorporated herein by reference as a
part of this resolution, disposing of Building No. 1 (Army-Air Force
Mess hall) and an unnumbered 20' by 40' quonset hut to the Department of
the Army, Corps of Engineers, acting as real estate agents for the U.S.
Air Force.
Section 2. This resolution shall take effect thirty (30) days
following adoption.

NOTE: RESOLUTION AND ATTACHED QUITCLAIM DEED WERE AMENDED AT THE MEETING
TO CONTAIN A REVERSIONARY CLAUSE WITH OWNERSHIP OF THE BUILDINGS REVERTING
BACK TO THE CITY IF NOT USED BY THE AIR FORCE. (C. Atty. Mary Hughes is to
supply reversionary language which is to be attached and incorporated as a
part of this resolution.)

KN<Jf ALL MEN BY llfESE PRESENTS:
WHEREAS, the city of Seward is owner and holder of record of certain
improvements on real property located in the city of Seward, Alaska, more
particularly described as follows:
Building No.1 (Army-Air Force Mess Hall) and an unnumbered 20'x40'
quonset hut, both of which are located within Lot 1, Tract A, U. S.
Survey 242, Seward, Alaska.
WITNESSETH:
NOW, THEREFORE, for and in consideration of the sum of ONE DOLLAR
($1.00), receipt whereof is hereby acknowledged, the City of Seward,
Alaska, a municipal corporation, does, by this Quit Claim Deed, grant and
convey unto the Department of the Army, Corps of Engineers, a department of
the U. S. Government, P. O. Box 898, Anchorage, Alaska 99506-0898, TO HAVE
AND TO HOLD fee simple title, together with all and singular, the
hereditaments and appurtenances thereunto belonging or in any wise
appertaining in and to the above described buildings located within Lot 1,
Tract A, U. S. Survey 242, Seward, Alaska.

THIS IS TO CERTIFY that on the day of May, 1985, before me,
the undersigned Notary Publ ic in and for the State of Al aska, personally
appeared RONALD A. GARZINI and LINDA S. MURPHY, to me known and known to me
to be the City Manager and City Clerk, respectively, of the City of Seward,
Alaska, and they acknowledged to me that the. foregoing instrument was
executed by them in their official governmental capacity, and that they
executed the same pursuant to the authorization of the City of Seward,
Alaska; that the same was executed as the free and voluntary act and deed
of the City of Seward, Alaska, for the uses and purposes therein mentioned,
and that the seal affixed hereto is the corporate seal of the City of
Seward, Al aska.
