CITY OF SEWARD, ALASKA
RESOLUTION NO. 95-148
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, TERMINATING THE AGREEMENT
BETWEEN THE CITY AND HOLLAND AMERICA LINE-
WESTOURS, INC., FOR PAYMENT OF ENGINEERING
WORK ON THE PROPOSED B STREET DOCK
WHEREAS, on June 12, 1995, the City Council approved Resolution No. 95-069, approving
an agreement between the City and Holland America Line- Westours, Inc., for financial assistance
for engineering work on the proposed B Street Dock; and
WHEREAS, under the terms of this agreement, the City agreed to reimburse Holland
America through reduced wharfage and docking fees if the B Street Dock was constructed or from
moneys reimbursed to the City by the Alaska Railroad for dredging assistance in the spring of 1995;
and
WHEREAS, the City paid for the engineering work from the budget appropriated by
Resolution No. 95-069 and has not sought reimbursement from Holland America; and
WHEREAS, it now appears that the B Street Dock will not be constructed; and
WHEREAS, it is, therefore, in the public interest to terminate the agreement with Holland
America and to fund the engineering work with reimbursements due to the City from Alaska
Railroad;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The agreement between the City of Seward and Holland America Line- Westours,
Inc., for the payment of engineering work on the proposed B Street Dock, is hereby terminated.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 11 th
day of December, 1995.
