CITY OF SEWARD, ALASKA RESOLUTION NO. 84-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE SMALL BOAT HARBOR UPLANDS MANAGEMENT MASTER PLAN WHEREAS, the Seward City Council, at its regular meeting of November 28, 1983, approved Resolution No. 83-91, adopting the Small Boat Harbor Uplands Management Master Plan; and WHEREAS, the City Council at that approval of the boardwalk development until such is established and public hearings held; and time withheld specific time as a concept plan WHEREAS, the City has completed an illustrated plan of the boardwalk development, and has found that the plan is in harmony with the overall future development plans in the harbor area; and WHEREAS, local businesses have invested substantially in the year-round economy of the Small Boat Harbor and Seward. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Seward Small Boat Harbor Uplands Master Plan is hereby amended to approve the boardwalk development concept in accordance with the artist's illustration (Exhibit A), the concession booth specifications (Exhibit B), artist's illustration of the conces- sion booth (Exhibit C), and proposed lease conditions (Exhibit D), all of which are attached hereto and incorporated herein as a part of this resolution. Section 2. Peddlers and solicitors, as outlined in City Ordinance No. 515, will not be allowed on City property in the Small Boat Harbor area unless the service or product to be sold is consistent with the needs of the area and is not being otherwise met by established local merchants. Attached sketch shows typical structure appearance. All structure designs are to be submitted to the City of Seward for review and approval by the City Manager and Building Department. 2. Floor plans, dimensions and intended use are to be approved by the City prior to construction or erection on the site. 3. Construction and appearance shall conform to the following general guidelines: a. Foundations are to be constructed of Pressure Treated All Weather Wood skids sufficient to carry structure loads. No creosoted materials will be allowed b. All doors, trim, posts and trusses are to be of wood construction. c. Siding shall be horizontally applied natural weathered cedar siding. d. Roof covering shall be corrugated metal 16 ga. roofing, factory painted. Color to be approved by the City. e. Interiors will be insulated and covered with mlnlmum jn gypsum wall board or other approved fire retardant panelling. f. If installed, electrical, mechanical and plumbing systems shall comply with all current building, fire and life safety, and health codes. (U.B.C. 1982, N.E.C. 1981, U.P.C. 1982, N.F.C. 1982, etc.) g. Electrical service connection will conform to all requirements of the City of Seward Electrical Utility Department. h. Signing may be either wood routed or painted, not to exceed 5' x 2' in size, and located on the front of the structure. 4. All structures and sbuildings will require a building permit and will con- form to the requirements of the City of Seward Building Code and all applicable National Codes in effect. 5. The maximum building size, including porch and eaves will be 30 feet by 22 feet. This size will be the exception rather than the rule. Minimum size structure will be 16 feet by 14 feet including the porch and eaves. . PROPOSED LEASE CONDITIONS 1. Use will be by lease for a period not to exceed 120 days per year. Lease fee will be $25 per month, maximum of $100 for the 120 days. This rate includes the fair market value of the land and administrataive costs. Future rates will be determined to inlcude value of the structure and main- tenance costs. 2. 3. Lessee will build the structure to City specifications. 4. Upon signing the lease and placing the structure on the site, the building becomes City property under the conditions of the lease. 5. 6. There will be no assignment or sbuleasing allowed. For 10 years, lessee will pay fair market rates for the land and the right to use the building. Lessee will have first right of refusal to lease the site provided the City is notified in writing prior to April 1st each year. Any break in use for one season voids the first right option. Main- tenance will be the responsibility of the lessee. 7. After the 10th year, use of the building will be, first come, first serve based on the needs of the harbor area and the City. Lease rate will be at a rate to include fair market value of the land, building and maintenance. The City will be responsible for maintenance. Until such time as water and sewer can be installed, there will be no food concessions allowed unless they can meet Alaska Department of Environmental Conservation and Health Department standards through other means, such as holding tanks etc. Concessions selling food that is prepared and packaged elsewhere in an approved kitchen may be an option. 9. 10. No overnite occupancy will be allowed. Lessee will be required to provide liability and property damage insurance commensurate with the City's requirements. The City will be named as a co-insured party. 11. Uses to be allowed in the boardwalk development complex will be limited to the otherwise unmet needs in the boat harbor area. Exhibit D
