CITY OF SEWARD, ALASKA RESOLUTION NO. 84-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING A COOPERATIVE AGREEMENT BETWEEN THE CHAMBER OF COMMERCE, THE ALASKA DEPARTMENT OF FISH AND GAME AND THE CITY AND ACCEPTING A GRANT FROM THE CHAMBER TO PROVIDE A TEMPORARY FISHERIES TECHNICIAN TO ASSIST THE LOCAL FISH AND GAME OFFICE WHEREAS, the Department of Fish and Game is attempting to develop a new fishery program and expand research on existing projects to enhance and diversify Resurrection Bay salmon sport fisheries; and WHEREAS, the Seward Chamber of Commerce wishes to support the efforts of the Department by providing funding to hire a temporary fisheries technician to aid in fisheries enhancement during the summer months; and WHEREAS, the Chamber of Commerce has agreed to reimburse the City for all salary and benefit costs if the City agrees to provide administrative payroll services for this proposed fisheries position; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to enter into the cooperative agreement with the Chamber of Commerce and the Alaska Department of Fish and Game which is attached hereto and incorporated into this resolution as Attachment A. Section 2. The City Manager is further authorized to accept a grant in the amount of $5,000 from the Seward Chamber of Commerce to establish Special Project Fund No. 293, Fisheries Enhancement, to be administered in accordance with said cooperative agreement. Section 3. This resolution shall take effect immediately upon its adoption. BE'IWEEN CITY OF SEWARD SEWARD OIAMBER OF CCMMERCE AND KLASKA DEPARIMENT OF FISH AND GAME The Alaska Departrrent of Fish and Garre is attempting to develop a ne-v fishery program and expand research on existing projects to enhance and diversify Fesurrection Bay sallOCm sport fisheries. A chinook (king) salrron sroolt release program, as requested by the Seward Chamber of Camerce in recent years, will be initiated in 1984 and continued in 1985. The ongoing Bear Lake fertilization experirrEnt to increase coho (silver) salrron production will be conducted in 1984 with research intensified on juvenile coho feeding habits, growth, distribution and interspecific canpeti tion with sockeye fry in the lake. New research will be in 1984 on the Seward Lagoon hatchery coho sroolt plant to deternrine optimum srrolt size, stocking density and release timing to maximize adult coho survival. .M.ditional new research is needed to estimate angler effort and salrron harvest in the rapidly expanding shoreline fisheries at Fourth of July, Lowell Point and adjacent Seward beaches. Arr-rent budget ceilings will not permit acccmplishrrent of the shoreline angling survey ~is year under the Department of Fish and Garre appropriation. Local hiring of a temporary employee appears to be one reans to acccmplish the foregoing new research tasks. This employee would preferably be a college student majoring in a Fisheries Fesearch Managanent curriculum to benefit fran the valuable research experience so derived to further his/her career in this field. The Seward Silver Salrron Derby fish restoration fund, derived fran yearly sales of sport-caught coho sallron to a local processor (Seward Fisheries, Inc.), contains sufficient rronies to pay the sal.ary and benefits of this temporary employee. The City of Seward has in place an employment structure to hire and pay such an employee for services rendered. The Alaska Department of Fish and Garre' s project leaders supervise and provide necessary transportation to seasonal and temporary employees to perform the various research/managercent activities to satisfy program objectives. WHERE2'IS, the City of Seward, Seward Chamber of Corrmerce and the Alaska Department of Fish and Garre recognize the need for and share a mutual concern that Fesurrection Bay's salrron resources be enhanced to inprove not only the quantity of coho and chinook salrron for harvest, but in so doing also the quality of the angling experience in this important marine sport fishery; NCW, THEREFORE, the parties hereto do hereby agree as follows: THE cm OF SEWARD AGREES: . To hire the employee, and pay his salary (hourly wage) , and workrrens canpensation, employment benefits, per designated pay period until August 31, 1984, or whenever no longer required, whichever occurs first. . . Page 2 . SEWARD CHAMBER OF CCM1EFCE AGREES: 1. To reimburse the City of Seward monies fran the Fish Restoration Fund to cover the employee's salary and employment benefits for the duration. . 3. .. 2. To maintain accurate accOl.mting of the Fish Restoration Fund, and infonu the Alaska Department of Fish a"ld Game of the fund's balance upon request. THE ALASKA DEPARIMENT OF FISH AND GAME AGREES: 1. To direct and supervise the employee and provide necessary transportation rreans to perfonu the aforementioned research activities. 2. To keep the City and Chamber abreast of research progress and findings regarding enhancement of Resurrection Bay 's salnon sport fisheries. ALL PARrIES MIJI'UALLY AGREE: 1. Nothing in this agreement shall obligate any party in the expenditure of funds, or for future payrrents of money, in excess of appropriations authorized by law. 2. Each party agrees that it will be responsible for its own acts and the results thereof and each party shall not be responsible for the acts of the other party; and each party agrees it will assurre to itself risk and liability resulting in any manner under this agreement. Each party will comply with all applicable laws, regulations, and executive orders relative to Equal Ellployment Opportunity. 4. Nothing herein is intended to conflict with Federal, State or local laws and regulations. If there are conflicts, this agreement will be amended at the first opportunity to bring it into confonnance with conflicting laws or regulations. 5. Policy and position annOl.:ncements relating specifically to this cooperative program may be made only by mutual consent of the agencies. 6. All signatory agencies/organizations shall rreet jointly on at least an annual basis to discuss matters relating to this agreement. 7. Upon tenuination of this agreement any equiprent purchased for studies initiated in furtherance of this agreanent will be returned to the agency of initial purchase. 8. That this Cooperative Agreement shall beccme effective when signed by the City Manager of Seward, the President of the Seward Chamber of Ccmrerce and the Crnmissioner of the Alaska Departrrent of Fish and Genre, and shall continue in force until August 3l, 1984, unless terminated earlier. Any signatory agency/organization may terminate its participation in this agreement by providing to all parties notice in writing 30 days in advance of the date on which its termination becares effective. - .
