CITY OF SEWARD, ALASKA
RESOLUTION NO. 84-77
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROPRIATING FUNDS FOR A MARINE
INDUSTRIAL CENTER SEWAGE TREATMENT FACILITY STUDY
WITHOUT UTILIZATION OF THE BID PROCEDURES AS SET
FORTH IN SECTION 10-8 OF THE SEWARD CITY CODE
WHEREAS, a domestic sewage treatment facility is essential for
the operation of industrial and prison facilities at the Marine Indus-
trial Center (MIC); and
WHEREAS, commitments were made by the City to provide such a
disposal facility during the prison site selection negotiations; and
WHEREAS, the majority of sewage will be generated from the
prison; and
WHEREAS, funding in the amount of $16,500 is required to enter
into a contract to prepare a study on the MIC Sewage Treatment Facility;
and
WHEREAS, complying with the bidding procedures of Section
10-8 of the Seward City Code would delay the permitting process and be
more costly to the City; and
WHEREAS, Pacific Management and Engineering Corporation (PM&E)
is designing the prison and has developed information necessary for the
design of the MIC Sewage Treatment Facility and PM&E is fully qualified
to do the study as part of the prison design;
NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The General Fund, Fund Balance Account No.
101-000-271-00-00 is hereby decreased by $16,500.
Section 2. The MIC Sewage Disposal Project Account No.
298-000-368-04-00 is hereby increased by $16,500.
Section 3. In accordance with Section 10-8(g) of the Seward
City Code, the City Council finds that it is in the public interest to
waive the bidding procedures as outlined in the Seward City Code for the
MIC Sewage Treatment Facility Study.
Section 4. The City Administration is hereby authorized to
executed a sole source contract with PM&E for the MIC Sewage Treatment
Facility Study in an amount not-to-exceed $15,000.

Section 5. This resolution shall take effect immediately upon
its adoption.
