RESOLUTION NO. 84-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, CONSENTING TO THE VACATION OF ALL
STREETS, RIGHTS-OF-WAY, EASEMENTS AND PROPERTY
LINES WITHIN THE TERMINAL ADDITION IN THE
CITY OF SEWARD
WHEREAS, the City of Seward is the sole owner of the property
known as the Terminal Addition; and
WHEREAS, the City has completed the preliminary engineering
and platting for the Gateway Subdivision--a replat of the Terminal
Addition; and
WHEREAS, the Kenai Peninsula Borough, the local platting
authority, requires that all such vacations be approved prior to a new
subdivision plat being final and recorded; and
WHEREAS, Kenai Peninsula Borough Code 20.28.100 provides that
no such vacation shall be approved within the city limits of an incor-
porated community without the consent of the City Council; and
WHEREAS, the vacation of all the streets, rights-of-way,
easements and property lines within the Terminal Addition is necessary
prior to the final approval of the Gateway Subdivision plat and the
subsequent development of the property; and
WHEREAS, the City Manager of the City of Seward has requested
that all streets, rights-of-way, easements and property lines within the
Terminal Addition be vacated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. Consent is given to the Kenai Peninsula Borough to
the vacation of all streets, rights-of-way, easements and
lines within the Terminal Addition.
Section 2. This resolution shall take effect immediately upon
its adoption.
