RESOLUTION NO. 83-61
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE ADMINISTRATION TO ENTER
INTO A TORA FOR THE DESIGN AND CONSTRUCTION OF A COAL LOADING
FACILITY
WHEREAS, the City of Seward agrees to design, construct and
operate the Seward Coal Loading project under the provisions of AS
35.15.080;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to apply to
the Alaska Department of Transportation and Public Facilities (herein-
after referred to as the "Department") on behalf of the City of Seward
for Three Million Six Hundred Thousand Dollars ($3,600,000.00) which was
appropriated to the Department in Chapter 107 SLA 83, Page 75, Line 7,
for the Seward Coal Loading Facility.
Section 2. THe City Manager is authorized to act on behalf of
the City of Seward to enter into an agreement with the Department to
transfer the responsibility for the accomplishment of the project from
the Department to the City of Seward, provided, however, that:
a. The City will own the completed facility;
b. The City will assume responsibility for operation and
maintenance of the completed facility;
c. The City will not be responsible for project cost
overruns, but will coordinate all costs with the
Department, the Alaska Railroad and Sun Eel Alaska
Corporation, and the City will, with the assistance of
the Department, work with the Governor and Legislature to
obtain any additional funds that may be necessary to
complete the facility;
d. The City will obtain all required operating tariffs and
will coordinate with the Department the preparation and
obtaining of said tariffs; and
Section 3.

visions contained in Section 2.
Section 4. This resolution shall take effect immediately upon
its adoption.
