CITY OF SEWARD, ALASKA ORDINANCE 2006-06 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING TITLE 15, PLANNING AND LAND USE REGULATIONS, AND TITLE 16, SUBDIVISIONS, TO DEFINE AND ALLOW FOR MARGINAL ACCESS STREETS UNDER CERTAIN CIRCUMSTANCES WHEREAS, Title 15, of the Seward City Code, Planning and Land Use Regulations, provides definitions for Seward City Zoning Code and Title 16, Subdivisions, provides definitions and street requirements for subdivisions; and WHEREAS, Kenai Peninsula Borough Code permits marginal access streets of at least forty feet in width; and WHEREAS, the City of Seward desires to add a similar provision to the City code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: .... The Seward City Code Title 15 and Title 16 are hereby amended to read as follows: (strike alit - deletions; bold italics = additions) Section 1. Seward City Code Title 15, Section 15.10.140, is amended by adding the following definition: Marginal Access Street. A dedicated public way providing access to four or fewer lots and not less than forty feet wide. Section 2. Seward City Code Title 16, Section 16.01.010, is amended by adding the following definition: Marginal Access Street. A dedicated public way providing access to four or fewer lots and not less than forty feet wide. - CITY OF SEWARD, ALASKA ORDINANCE 2006-06 ~. 1 l ...... Section 3. Seward City Code Title 16, Section 16.05.010, is amended to read as follows: The tenn "required public improvements" shall mean the following: 1. Streets. All streets located within a subdivision subject to the requirements of this Title shall be not less than fifty feet in width and shall be gravel-surfaced according to city specifications; provided, however, a marginal access street providing access to four or fewer lots and not less than forty feet wide may be allowed subject to approval by public works, the eli!ctric and fire department, and to be constructed according to city specifications, including a surface type consistent with the connecting streets. 2. Telephone and electric lines. All new telephone and electric lines shall be installed underground, unless found to be impractical by the city planning and zoning commission and affinned by the city council, and in accordance with specifications of the appropriate utility companies and the city. 3. Water svstem. Where the city water system will service the area covered by the plat or proposed plat, the subdivider shall provide the water system in accordance with the specifications established by the city planning and zoning commission and affinned by the city council. Fire hydrants shall be provided to standards established by the American Waterworks Association and shall be a brand specified by the city. The subdivider shall not be required to drill individual wells. ~ ..... 4. Sewer system. Where the city sewer system will service the area covered by the plat or proposed plat, the subdivider shall provide the sewer system in compliance with all applicable state and federal health and environmental laws and regulations. 5. Street lighting. Street lighting shall be installed in accordance with the requirements of the city. Section 4. This ordinance shall take effect 10 days following enactment.
