CITY OF SEWARD, ALASKA
ORDINANCE 2001-03
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE TITLE 15, LAND USES
ALLOWED TABLE 15.10.225 TO PROHffiITHOTELS, MOTELS, LODGES
AND INNS IN THE MULTI-FAMILY RESIDENTIAL ZONING DISTRICT
WHEREAS, the Multi-Family Residential (R3) Zoning District is intended to provide
opportunities for a higher density residential setting with a mix of housing units which are
predominately multi-family units close to concentrations of public services, employment and/or
recreation; and
WHEREAS, the Zoning Code currently allows hotels, motels, lodges and inns in the Multi-
Family (R3) Zoning District by conditional use permit from the Planning and Zoning Commission;
and
WHEREAS, hotels, motels, lodges and inns are also allowed by conditional use permit in the
Harbor Commercial and Central Business Districts, and as an outright use in the Auto Commercial
District; and
WHEREAS, the Zoning Code allows for single and multi-family dwellings to be used for
overnight lodging in the R3 Zoning District. However, the operation is limited in single-family
residences and duplexes to a home occupation. Multi-family dwellings are allowed to use up to five
(5) apartment units for overnight lodging; and
WHEREAS, the intent and purpose ofthe lodginglbed and breakfast regulations was to limit
the commercial impact of overnight lodging in the residential neighborhoods in order to protect their
residential character; and
WHEREAS, it is in the public interest to maintain a city code that is up to date and in tune
with current community needs; and
WHEREAS, at its April 3, 2001 meeting, the Planning and Zoning Commission held a public
hearing and recommended City Council approval of the proposed Zoning Code amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Title 15 Seward City Code Table 15.10.225 Land Uses Allowed is hereby
amended to prohibit "Lodging, hotel, motel, lodge, inn" in the Multi-Family Residential Zoning
District.
Section 2.
This ordinance shall take effect ten (10) days following its enactment.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this
14th day of May, 2001.
