HomeMy WebLinkAboutOrd2001-004 I I I Sponsored by: Planning & Zoning Commission Introduction: April 23, 2001 Public Hearing: May 14, 2001 Enactment: May 14, 2001 CITY OF SEWARD, ALASKA ORDINANCE 2001-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE LAND USE PLAN AND ZONING DESIGNA- TION OF A PORTION OF ALASKA RAILROAD RIGHT-OF-WAY FROM INDUSTRIAL TO AUTO COMMERCIAL WHEREAS, the Alaska Railroad Corporation has requested that the Land Use Plan and Zoning designation of a portion of Alaska Railroad Right-of-Way be changed from Industrial to Auto Commercial (AC); and WHEREAS, because the property is contiguous with Lot 1, Block 2, North Harbor Subdivision which is zoned Auto Commercial, the request meets the City Code requirement (SCC 15.01.035.B.3) for amending the Land Use Plan and Zoning designation because it expands the boundary of the existing, contiguous Auto Commercial district; and WHEREAS, this property is physically separated from the adjoining Alaska Railroad Right- of-Way to the east by a creek and railroad tracks; and WHEREAS, the utility and development potential of Lot 1, Block 2, North Harbor Subdivision, and a portion of Alaska Railroad Right-of-Way are enhanced by assemblage; and WHEREAS, although the Seward Comprehensive Plan recommends against expanding the boundaries of the Auto Commercial District, the request is consistent with the Strategic Plan which recommends promoting commercial in-fill development inside the City; and WHEREAS, the Auto Commercial district is intended to accommodate highway-oriented commercial activities such as offices, certain institutional uses, limited personal services and retail uses; and WHEREAS, at its April 3, 2001 meeting, the Planning & Zoning COmniission held a public hearing and recommended City Council approval of the Land Use Plall aild Zoning amendment included in this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEW ARD, ALASKA HEREBY ORDAINS that: Section 1. The Official City of Seward Land Use Plan and Zoning Map is hereby amended by changing the land use plan and zoning designation of the portion of Alaska Railroad Right-of- Way identified on the attached Exhibit A, from Industrial to Auto Commercial. The property is bordered by Alaska Railroad lease contract 5862 to the north, Port Avenue to the south, Lot 1, Block 2, North CITY OF SEWARD, ALASKA ORDINANCE 2001.04 Harbor Subdivision to the west, and the unnamed creek within Alaska Railroad Right-of-Way to the east. Section 2. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 14th day of May, 2001.
