HomeMy WebLinkAboutOrd2001-007 I I I POSTPONED INDEFINTEL Y Introduction Date: November 19, 2001 Public Hearing Date: Sponsored by: Clark, Shafer CITY OF SEWARD, ALASKA ORDINANCE 2001-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE TITLE 15, PLANNING AND LAND USE REGULATIONS, REDUCING THE BUILDING HEIGHT RESTRICTIONS FOR A PORTION OF THE SMALL BOAT HARBOR ALONG FOURTH AVENUE FROM 34 FEET, WHICH CURRENTLY ALLOWS FOR THREE STORY BUILDINGS, TO 26 FEET, WIDCH WOULD ALLOW FOR TWO STORY BUILDINGS WHEREAS, currently within the Harbor Commercial Zoning District in the area bounded by Fourth Avenue, the boat launch ramp, the harbor basin and J Float Ramp, maximum building height is 26 feet. All other property in the City is subject to a 34 foot maximum building height; and WHEREAS, the 34 foot building height allows for three story buildings, and the 26 foot building height limits buildings to two stories; and WHEREAS, according to the Zoning Code the purpose of building height standards is to prevent loss of life or excessive property damage through the inability of the city fire departments to reach upper stories or roofs and to help maintain the character of neighborhoods; and WHEREAS, the proposed ordinance would extend the 26 foot building height requirement northward to include the portion of Alaska Railroad right-of-way south of Port Avenue and the city- owned Lot 1, Block 2, Marina Subdivision; and WHEREAS, limiting the building height on the east side of Fourth Avenue within the Small Boat Harbor area is consistent with recommendations of the Comprehensive Plan and the Small Boat Harbor Management Plan; and WHEREAS, the Planning and Zoning Commission held a public hearing, reviewed the proposal to expand the 26 foot building height limit at its November 6,2001 meeting, and voted against introducing such a Zoning Code amendment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code Table 15.10.220 Development Requirements - Notes is hereby amended as follows: Note 1. Within the HC District, in the areas bounded by Fourth Avenue, the boat launch ramp, the harbor basin, and J-Float Ramp [the southern extension ofLeirer Road identified on Marina Subdivision Block 2 (plat No. 89-10) and Port Avenue,] building height is limited to 26 feet.
