(Old. 493, ~ l(pc\1t), 1980, Old. 96-07) CITY OF SEWARD, ALASKA ORDINANCE 2002-02 2.25.030 Engineering and Construction department-established. There is established the city of Seward engineering and construction department. The principal officer shall be the manager of engineering and construction who shall fulfill the duties and have the responsibilities as set forth in the employee's job description, and who shall be subject to the direction and supervision of the city manager. (Ord. 493, i 1 (part), 1980,' Ord. 96- 07, Ord. 2002-02) 2.25.035 Engineering and Construction department-powers and duties. The engineering and construction department shall: 1. work with the public works department to provide for the planning, design, construction, maintenance and repair, and improvement of all public works owned or operated by the city; 2. provide necessary technical engineering services to other city departments,' 3. coordinate the engineering and planning activities of the water and sewer utilities owned and operated by the city on matters of mutual concern, between the utilities and public works; 4. inspect all construction work done by andfor the city and require compliance with all contracts made in connection therewith; 5. prepare all official maps of the city and maintain such records as are necessary for the fulfillment of the departmental function, and shall record thereon any changes on the official copy maintained by the department,. 6. prol'ide other services and duties as may be reasonably related and as directed by the city manager; 7. provide for the lawful compliance of new construction and building renovation within the city limits by the issuance of building permits and the performance of building inspections, regulating buildings, housing, fire zones, plumbing, heating and electrical installations; 8. provide for the abatement of dangerous buildings and public nuisances according to law; 9. coordinate services with the borough assessor to provide such records of building changes which would affect the borough assessed valuation for tax purposes,. 10. plan and manage municipal capital and special construction projects; 11. work with the public works department to obtain easements necessary for the maintenance and extension of the water and sewer utilities; 12. be responsible for the function of traffic engineering for the city; 13. work with the public works department to provide policies and procedures pertaining to the management, operation, design, construction, repair, development, maintenance, improvement and extension of the city water and sewer utilities; 14. cooperate and coordinate departmental efforts with the fire department and the public works department in the installation, repair and maintenance of a water system adequate for the needs of the fire department,'(Or(l 493, jl(part), 1980; Ord. 96-07, Ord. 2002-02) I I II CITY OF SEWARD, ALASKA ORDINANCE 2002-02 2.25.070 Electric Utility department-established There is established the city of Seward electric utility department. The principal officer shall be the manager of electric utility who shall fulfill the duties and have the responsibilities as set forth in the employee's job description, and who shall be subject to the direction and supervision of the city manager (see j 2.20.015 regarding council approval of appointment). (Ord 493, j1(part), 1980; Ord 96-07, Ord 2002-02) 2.25.075 Electric Utility department-powers and duties. The electric utility department shall: 1. recommend a schedule offees and rates to be chargedfor services performed by the electric department; 3. provide other services and duties as may be reasonably related and as directed by the city manager; 4. provide policies and procedures pertaining to the management, operation, design, construction, repair, development, maintenance, improvement and extension of the electric utility owned and operated by the city; 5. maintain such maps and records as are necessary for the fulfillment of the departmental function and record thereon any changes on the official copy; 6. obtain easements necessary for the maintenance and extension of the electrical system; 7. provide advice and assistance in formulating policies and rate schedules to be used in the sale of services and answer customers' inquiries regarding the electrical tariff; 8. install, maintain and operate the street lighting system of the city; 9. provide for the necessary inspections relative to new and extended electrical services. (Ord 493, j1(part), 1980; Ord 96-07, Ord 2002-02) 2.25.080 Public Works department-established There is established the city of Seward public works department. The principal officer shall be the public works director who shall fulfill the duties and have the responsibilities as set forth in the employee'sjob description, and who shall be subject to the direction and supervision of the city manager (Ord 493, j1(part), 1980; Ord 96-07, Ord 2002-02) 2.25.085 Public Works department--powers and duties. The public works department shall: 1. work with the engineering and construction and electric utility departments to provide for the planning, design, construction, maintenance and repair, and improvement of all public works owned or operated by the city; 2. recommend a schedule of fees and rates to be charged for services performed by his department; 3. provide other services and duties as may be reasonably related and as directed by CITY OF SEWARD, ALASKA ORDINANCE 2002-02 the city manager; 4. maintain such maps and records as are necessary for the fulfillment of the departmental function and record thereon any changes on the official copy; 5. provide advice and assistance in formulating policies and rate schedules to be used in the sale of services and answer customers' inquiries regarding the water and sewer services; 6. operate the city garage and machine shop, keeping a record of the work performed; 7. maintain the operating records of all motorized equipment used or operated by the city; 8. provide for a preventive maintenance program for all mechanical equipment owned and operated by the city,. 9. provide maintenance for all public buildings and mechanical equipment of the city; 10. be responsible for the function and maintenance of all markings for traffic control placed upon the streets or curbs; 11. work with the engineering and construction department to provide policies and procedures pertaining to the management, operation, design, construction, repair, development, maintenance, improvement and extension of the city water and sewer utilities; 12. cooperate and coordinate departmental efforts with the fire department and the engineering and construction department in the installation, repair and maintenance of a water system adequate for the needs of the fire department; 13. provide for the necessary inspections relative to new and extended water and sewer services. (Ord. 493, j 1 (part), 1980,' Ord. 96-07, Ord 2002-02) TITLE 3 PERSONNEL Chapter 3.01 Objectives and Scope 3.01.035 Definitions. E. TITLE 9 HEALTH AND SAFETY Chapter 9.25 Noise Control 9.25.030 Exceptions The provisions of the chapter shall not apply to: I I II CITY OF SEWARD, ALASKA ORDINANCE 2002-02 A. noncommercial public speaking or public assembly activities conducted in any public space or public right-of-way; or B. The emission of sound for the purpose of alerting persons to the existence of any emergency, the emission of sound in the performance of emergency work, or the emission of sound in the performance work by city departments including, but not limited to, the harbor, police, fire, electric and en8iu.eel ing .'uta utilities public works ( for example emergency response and snow removal). (Ord. 97-21, Ord 2002-02) TITLE 11 VEHICLES AND TRAFFIC Chapter 11.05 Traffic-Control Devices 11.05.010 Authority to install. The public works depA,Lillc,nt supel visor director, under the direction of the city manager, shall place and maintain traffic-control signs, signals and devices when and as required under this title and other traffic ordinances of this city to make effective such provisions, and may place and maintain such additional traffic-control devices as he may deem necessary to regulate traffic under this title and other traffic ordinances of this city or under state law, or to guide or warn traffic. (Ord. 368, ~ 2.19, 1969; Ord. 610, 1988, Ord 2002-02) 11.05.045 Crosswalks and safety zones. The public works dcpll.l tmGllt S...pCI v isol director, under the direction of the city manager, is hereby authorized: 1. to designate and maintain, by appropriate devices, marks or lines upon the surface of the roadway, crosswalks at intersections where in his opinion there is particular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary; 2. to establish safety zones of such kind and character and at such places as he may deem necessary for the protection of pedestrians. (Ord. 368, ~ 2.26, 1969, Ord 2002-02) 11.05.050 Traffic lanes. A. The public works dCpA,l,lkIlL supelv isol director, under the direction of the city manager, is hereby authorized to mark traffic lanes upon the roadway of any street or highway where a regular alignment of traffic is necessary. B. Where such traffic lanes have been marked, it shall be unlawful for the driver of any vehicle to fail or refuse to keep such vehicle within the boundaries of any such lane except when lawfully passing another vehicle or preparatory to making a lawful turning movement. (Ord. 368, ~ 2.27, 1969, Ord 2002-02) 11.05.055 Streets closed to traffic. CITY OF SEWARD, ALASKA ORDINANCE 2002-02 A. The chief of police, .,up~nisol of public works depAJtmcnt director or the city manager shall be authorized to close streets to traffic. B. Whenever any street is closed to the use of traffic and the same is so indicated by authorized signs or barriers, no vehicle shall proceed into such street or any portion thereof except as directed by such signs. Whenever a street is closed, notice shall immediately be given to the fire chief. C. No person, public utility or any city department shall erect or place any barrier or sign on any street or sidewalk, unless first authorized by the director of public works or the city manager. This section does not apply to street closures effected by the department of police as authorized by subsection A. of this section. (Ord. 368, ~ 2.28, 1969, Ord 2002-02) Chapter 11.15 Stopping, Standing and Parking 11.15.085 Parking prohibited during certain hours. A. The public works depat tmc.nt snpeJ v iS~1 director is hereby authorized to determine and designate by proper signs, places in which stopping, standing or parking of vehicles during certain hours of the day would create a hazardous condition or would cause unusual delay to traffic. B. When signs are placed on streets prohibiting parking of vehicles, no person shall park any vehicle in closed or restricted areas, and any vehicle found so parked shall be impounded. C. When official signs prohibiting parking during certain hours of the day are erected as authorized, no person shall stop, stand or park a vehicle in any such designated place. (Ord. 368, ~ 9.100, 1969; Ord. 96-32, Ord 2002-02) 11.15.087 Parking prohibited during snow and ice removal operations. A. In the downtown area, designated as those streets between Railway and Jefferson Streets and between Fourth and Fifth Avenues, and in the harbor area, designated as that portion of Fourth Avenue between North Harbor and South Harbor Streets, it shall be unlawful for any person to park on those streets during the hours indicated on temporary signs which will be placed on the streets by the :Cn~iJ1c.clin~ and UtiIitic.s Public Works Department prior to any snow removal operations. Vehicles parked in violation of this section will be impounded. B. In all other areas ofthe city, other than the "downtown" area, it shall be unlawful for any person to park, or cause a vehicle, camper, boat or other item to be parked, on the right-of-way for longer than 24 hours during those times when snow removal by the :CJ18ine"'l~n~ and Ut;Iitics Public Works Department is occurring. Vehicles parked in violation of this section shall be impounded. C. Whenever any police officer finds, or is notified by the Managel ofEI18itle(,!il18 ll.hd Util~t;(,s Depll.l tJllwt public works director or his designated representative, that a vehicle is in violation of this section, the officer is authorized to require the owner, driver or other person responsible for the vehicle to remove the vehicle to a position off the area requiring snow removal, or the officer may have the vehicle impounded. (Ord. 96-32, Ord 2002-02) I I I CITY OF SEWARD, ALASKA ORDINANCE 2002-02 Chapter 11.25 Sizes, Weights and Loads 11.25.050 Load restrictions on certain streets. The public works depm tment SupCI v isol director with the advice of the city manager, is hereby authorized to determine and designate those streets or highways upon which vehicles of a gross weight permitted in ~ 11.25.030 would create a hazard or cause undue damage to the roadway and shall erect appropriate signs stating the reduced gross weight permitted on such designated streets. When signs are so erected giving notice thereof, no person shall disobey the restrictions stated in such signs. (Ord. 368, ~ 11.117, 1969; Ord. 610, 1988, Ord 2002-02) Section 2.
