RESOLUTION 2005-40

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT WITH QUALITY ASPHAL T PAVING
TO OPERATE WITHIN THE CITY'S QUARRY AND PURCHASE
UNCLASSIFIED ROCK AT THE PRICE OF $1.00 PER TON, WITH
OTHER STIPULATIONS
WHEREAS, Quality Asphalt Paving ("QAP") has requested that the City allow them
to classify and remove approximately 60,000 ton of unclassified material from the City's
quarry; and
WHEREAS, the City does not currently have the equipment to sort this unclassified
material, and the existence ofthis pile does not allow for maximum efficient use of the pile
and it is therefore in the City's interests to sell this material to QAP; and
WHEREAS, the City agrees to sell this material at a price of$I.00 per ton, with the
stipulation that at the completion of the project, QAP will leave a set of Department of
Transportation-certified truck scales with a minimum value of $20,000 in the quarry, with
said scales becoming the property of the City of Seward.
__ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. The City Council of the City of Seward hereby authorizes the City
Manager to enter into a contract with Quality Asphalt Paving, to sell approximately 60,000
ton of unclassified material at the price of$I.00 per ton, with the understanding that the City
will own a set of certified truck scales valued at least $20,000, at the completion of QAP's
operations within the quarry.
Section 2. This resolution shall take effect immediately after adoption.

23rd day of May, 2005.
