CITY OF SEWARD, ALASKA RESOLUTION 2005-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A SOLE SOURCE CONTRACT FOR EMERGENCY ENGINEERING AND REPAIR WORK TO THE SPRING CREEK WATER TANK, AUTHORIZING FUNDING IN AN AMOUNT NOT -TO-EXCEED $450,000, AND APPROPRI- ATING FUNDS WHEREAS, the Spring Creek Water Tank is a 500,000 gallon water tank that services the domestic water supply and fire-fighting needs of the prison, ship yard, and marine industrial center; and WHEREAS, due to heavy snow loads and water saturation ofthe roof foam, the roofbeams of the water tank have twisted and are on the verge of failing; and WHEREAS, the City of Seward must immediately make the needed repairs to this tank in order to avert the potential serious consequences of a tank failure, due to the fact that this area of town has no backup water storage system in place; and .... WHEREAS, the City Manager has determined that the potential catastrophic consequences of a failure elevate this issue to that of an emergency, exempting the procurement of professional services to repair the tank from further competitive procurement procedures per Seward City Code Sections 6.10.120(a)(2) ("where an emergency makes the delay incident to competitive bidding unreasonable") and SCC 6.10.120(a)(8) (where professional services, including engineering and other specialized services, are exempt from competitive procurement); and WHEREAS, the City will make all reasonable efforts to secure a fair price quotation for the required services, basing its selection of a contractor on such factors as repair qualifications, cost effectiveness, and immediate availability. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Council of the City of Seward hereby authorizes the city manager to enter into a sole source contract for emergency engineering and repair work to the Spring Creek water tank, for an amount not-to-exceed $450,000. -- CITY OF SEWARD, ALASKA RESOLUTION 2005-49 J Section 2. The City Council of the City of Seward finds that it is in the public interest to WaIve the competitive procurement procedures pursuant to SCC 6.10.120(a)(2) and SCC 6.1 0.120(a)(8) per the recitals above. Section 3. The amount of$450,000 is hereby appropriated as follows: $430,000 from the Capital Acquisition Fund account no. 103-0000-3070-0707, and $20,000 from the Water Enterprise Fund account no. 701-0000-3070-0707, to the Spring Creek Water Tank Fund no. 707-7071-5930. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13th day of June, 2005.
