RESOLUTION 2005-103
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE EMPLOYMENT AGREEMENT WITH THE
CITY CLERK
WHEREAS, Jean Lewis has been employed by the City Council in Seward, Alaska as the
City Clerk since May 22, 2002; and
WHEREAS, Jean Lewis successfully completed her three years of Professional
Development to acquire the certified municipal clerk (CMC) designation August 31, 2004; and
WHEREAS, Lewis has received two above satisfactory evaluations per year from the City
Council since her start date; and
WHEREAS, the City Clerk does not participate in standard employee merit step increases
or COLA as outlined in the Seward City Code, and any increase in payor annual leave accrual must
be by an amendment to the employment agreement; and
WHEREAS, City Council desires to increase Lewis' salary by 2.5 percent effective pay
-- period beginning January 1, 2006; and
WHEREAS, the City Council wishes to amend the employment agreement to add eligibility
for Family Medical Leave Act (FMLA) and bereavement leave as outlined in Seward City Code
3.45.040(f) and 3.45.095; and
WHEREAS, the City Clerk has received a step increase each year since hired; and
WHEREAS, Lewis' contract states City Council agrees to review Lewis' salary annually
prior to adoption of the City's fiscal budget; and
WHEREAS, this increase has already been factored into the FY 2006 budget.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. Amendment No.3 to the City Clerk's employment agreement dated May 13,
2002 between the City of Seward and Jean Lewis, increasing the annual salary is hereby
approved.
Section 2. The effective date ofthe salary increase shall be January 1, 2006.
Section 3. Eligibility for FMLA and bereavement leave under Seward City Code 3.45.040(f)
and 3.45.095 are hereby added to this agreement.
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 24th
day of October, 2005.

Agenda Item: Resolution 2005-103, amending the
City Clerk
Employment Agreement.
BACKGROUND & JUSTIFICATION:
Jean Lewis has been employed by the Seward City Council as the City Clerk since May 22, 2002.
The city clerk does not participate in standard employee step increases or cost of living allowances
(COLA) as outlined in the Seward City Code, and any increase in pay or annual leave accrual must be
by an amendment to the employment agreement. The attached resolution reflects a 2.5% increase
over the clerkâs current salary. This is the equivalent of what all city employees who receive a merit
increase with acceptable annual evaluations are eligible for.
These changes were already factored into the 2006 budget currently under review.
Also, upon reviewing the employment contract, it was discovered that bereavement leave was
inadvertently excluded from the contract as was FMLA eligibility. It is believed these are oversights
and are basic benefits to all city employees, as well as state and federal workers (bereavement leave
was added to the city code sometime in 2002, which may have been after the signing of the first
contract).

RECOMMENDATION:
Council approve Resolution 2005-103, amending the employment contract of Jean Lewis to allow for
a pay increase of 2.5% effective January 1, 2006, and amending 3.45 to include FMLA and
bereavement eligibility.
