HomeMy WebLinkAboutRes2005-132 Failed Sponsored by: Schafer - CITY OF SEWARD, ALASKA RESOLUTION 2005-132 A RESOLUTION OF THE CITY COUNCIL OF SEWARD, ALASKA, TO VETO THE KENAI PENINSULA BOROUGH PLANNING COMMISSION VACATION OF A PORTION OF WASHINGTON STREET WHEREAS, the Kenai Peninsula Borough (KPB) Planning Commission voted to approve the partial vacation of Washington Street on November 28,2005; and WHEREAS, the National Park Service has viable alternatives for a single facility that does not require vacation of a portion of Washington Street; and WHEREAS, the Legends property and Washington Street vacation equals 18,164.5 square feet; combined with the Solly property, the total becomes 20,778 square feet; and WHEREAS, within approximately 150 feet ofthe Legends property, the National Park Service has purchased property on the east side of Fifth Avenue, totaling 23,958 square feet; and .... WHEREAS, the Seward Planning and Zoning Resolution 2005-23, Section 1, subsection 2 has not been complied with; and WHEREAS, the Seward City Council has. very recently, authorized the purchase of additional land for the future museum/library complex, which would benefit by the close proximity of the Mary Lowell Center on the east side of Fifth Avenue; and WHEREAS, per KPB 20.28.010, KPB 20.28 is a means by which to establish vacation procedures for the transfer of unnecessary ROWs; and WHEREAS, is currently paved, has street parking, has sidewalks on each side, and is in use at this time; and WHEREAS, there is no record of any previous vacation of a constructed street in the downtown Seward area; and WHEREAS, no vacation of a city ROWand/or easement may be made without the consent of the City Council; and - WHEREAS, the 2A concept locates the building in the storm surge area as well as being in a tsunami zone; and CITY OF SEWARD, ALASKA RESOLUTION 2005-132 .... WHEREAS, passage of this resolution maintains the integrity of all the historic streets of Seward, Alaska. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA: Section 1. The City Council hereby officially vetoes the partial vacation of Washington Street as set forth in the Kenai Peninsula Borough Planning Commission's decision of November 28,2005. Section 2. The City Manager will notify the KPB Planning Commission of this decision by December 20,2005. Section 3. This resolution shall take effect immediately. COUNCIL AGENDA STATEMENT Meeting Date: December 12, 2005 From: Steve Schafer, Council Member Agenda Item: A Resolution of the City Council of Seward, Alaska, to veto the Kenai Peninsula Borough Planning Commission’s Resolution to vacate a portion of Washington Street BACKGROUND & JUSTIFICATION: On November 28, 2005 the Kenai Peninsula Borough (KPB) Planning Commission voted to approve the partial vacation of Washington Street. This Resolution is intended to veto the KPB’s resolution to vacate a portion of Washington Street. CONSISTENCY CHECKLIST: Where applicable, this agenda statement is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
