HomeMy WebLinkAboutRes2005-128 Sponsored by: Corbridge, Dunham - CITY OF SEWARD, ALASKA RESOLUTION 2005-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE PURCHASE OF SWOOOOOOI TOlS ROt W SIO ORIGINAL TOWNSITE OF SEWARD LOT t BLOCK 8 and SWOOOOOOt TOtS ROt W StO ORIGINAL TOWNSITE OF SEWARD LOT 2 LOT 3 LOT 4 LOT 5 LOT 6, AS THE FUTURE LOCATION OF THE SEWARD COMMUNITY LIBRARY MUSEUM, FOR THE PURCHASE PRICE $290,000.00 WHEREAS, members of the community have met repeatedly and endorsed the concept of a combined library museum for Seward; and WHEREAS, the City Council commissioned and received a design concept for a community library museum; and WHEREAS, there is a need to designate and secure a locatio!\. for the proposed Seward Community Library Museum in order to seek capital funds for the project in good faith; and - WHEREAS, this particular site has been discussed, agreed upon and proposed by the community library museum capital campaign planning group as a preferred site for the project; and WHEREAS, said property has been vacated by owner and owner is a willing seller; and WHEREAS, City ownership of this centrally located, currently vacant property will insure the property will be properly maintained during the interim fund raising campaign for the library museum; and WHEREAS, the removal of these properties from the property tax rolls will result in minimal impact to the public revenue stream; and WHEREAS, in accordance with Seward City Code F.05.l20, the City Manager has negotiated the purchase ofthe lots located at the comer of Sixth Avenue and Adams Street with the current owner, the Salvation Army, for a purchase price of two hundred ninety thousand dollars ($290,000.00) which includes a ten thousand dollar ($10,000.00) earnest money payment; and WHEREAS, a public hearing meeting the requirements of Seward City Code ~7.05.l25 was held on November 28, 2005. - NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to finalize the purchase and accept a Warranty Deed for SWOOOOOOI TOI S ROI W S I 0 ORIGINAL TOWNSITE OF SEWARD LOT I BLOCK 8 and SWOOOOOOI TOIS ROIW SlO ORIGINAL TOWNSITE OF SEWARD LOT 2 LOT 3 LOT 4 LOT 5 LOT 6 for the purchase price of two hundred ninety thousand dollars ($290,000.00). , I J ...... Section 2. In accordance with Seward City Code ~7.05.135, the City Council finds that the essential terms and conditions of this land purchase, two hundred ninety thousand dollars ($290,000.00), and the method of acquisition, by negotiation as authorized in Seward City Code ~7.05,120, is in the public interest. Section 3. Funding to purchase the lots will be provided by appropriating two hundred ninety thousand dollars ($290,000.00) from the Land Acquisition Fund fund balance 103-0000-3050 to the Land Acquisition Fund 101-1180-5910. Section 4. This resolution shall take effect 30 days after passage and posting, as required by Seward City Code ~7.05.145. Council Agenda Statement Meeting Date: November 28, 2005 Through: Clark Corbridge From: Patricia Linville, Library Director Agenda Item: Authorizing the City Manager to enter into a purchase agreement with the Salvation Army and obtain title to SW0000001 T01S R01W S10 ORIGINAL TOWNSITE OF SEWARD LOT 2 BLOCK 8 LOT 3 BLOCK 8 LOT 4 BLOCK 8 LOT 5 BLOCK 8 LOT 6 BLOCK 8 and SW0000001 T01S R01W S10 ORIGINAL TOWNSITE OF SEWARD LOT 1 BLOCK 8 for the negotiated price of Two Hundred Ninety Thousand Dollars $290,000 for the purpose of providing a site location for a library museum facility for the City of Seward. BACKGROUND & JUSTIFICATION: The Seward Legacy Committee formed by Former Seward Mayor, Edgar Blatchford, identified a library/museum facility as one of its major projects. The Downtown Waterfront Development Committee formed by former Seward Mayor Clark included a library/museum in their planning designs. In July 2003 the City of Seward passed a resolution funding the development of a Design Concept for a Combined Seward Community Library and Museum. Using an interactive programming/concept design process to encourage community involvement, Architects Alaska developed the Seward Community Library and Museum Preliminary Program and Design Concept in December 2004. The design was based on information, ideas and feedback from Seward residents collected at community meetings and through surveys. In April 2005 the Seward Community Library Association and the Resurrection Bay Historical Society contracted with Ann Myren and Cicely Stern from Haines to conduct a workshop on capital campaigns for public buildings. Myren and Stern are capital campaign consultants with an emphasis and expertise in raising funds for library buildings. The capital campaign meeting attendees included library staff and board members, museum staff and Resurrection Bay Historical Society members, City staff, Council representatives and interested members of the community. The group focused on project strategic planning, capital campaign preparation and development of a local fundraising plan for the project. Myren and Stern emphasized that before the Seward Community Library Museum project could be seen as a serious contender for major private funds the project would have to have a designated site for the building. The community members at the capital campaign meeting discussed possible sites and came to consensus that the recently vacated property next to the library would be an ideal location for the library museum facility for the following reasons: Property is located in the City services area. The current library building is adjacent to the property being considered. Locating the new library facility in close proximity to the current facility and in the “downtown area” is in keeping with the wishes of community. This location preference was voiced, discussed and mutually agreed upon at all of the community meetings mentioned above. Availability of property The Salvation Army has vacated the property and has no future plans for its use. The Salvation Army has indicated they are willing to negotiate with the City in a fair and reasonable manner to assure the property can be made available for the library museum. City ownership of the property will insure proper maintenance of buildings and grounds during the 3-5 year capital campaign to raise money for the project. The 2005 Salvation Army tax liability to the borough and city was five hundred and three dollars and eighty five cents ($503.85). This was assessed on Parcel #14913018 which is the site of the former Salvation Army storefront and zoned commercial. The remaining property is zoned private and as a non-profit the Salvation Army is tax exempt for private property holdings. The loss of this revenue will be of minimal impact to the borough and city. Possible interim uses of the property during the capital campaign for the library museum facility include potential storage sites for the city and/or useable property could be leased until construction begins. During the April 25, 2005 City Council meeting directed the City Manager to move forward on acquiring the preferred site. Clark Corbridge and Willard Dunham have negotiated with the Salvation Army and settled on the purchase price of two hundred and ninety thousand dollars ($290,000.00) for the six (6) lots. Earnest money in the amount of ten thousand dollars ($10,000.00) has been submitted to secure the negotiated sale and will be a portion off the total price. CONSISTENCY CHECKLIST: Where applicable, this agenda statement is consistent with the Seward City Code, Charter, Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures. Other: _______________________________________________________________________ FISCAL NOTE: The two hundred and ninety thousand dollars ($290,000.00) purchase price of the property will be come out of the balance account no. 101-0000-3050 to the General Fund general services land account no. 101-1180-5910 Approved by the Finance Department_________________________________________ RECOMMENDATION: Council approves Resolution 2005-128 authorizing the city manager to enter into an agreement with the Salvation Army to purchase SW0000001 T01S R01W S10 ORIGINAL TOWNSITE OF SEWARD LOTS 2, 3, 4, 5, and 6 of BLOCK 8 and SW0000001 T01S R01W S10 ORIGINAL TOWNSITE OF SEWARD LOT 1 BLOCK 8 as the future site of the Seward Community Library Museum for the negotiated price of two hundred and ninety thousand dollars ($290,000.00).
