RESOLUTION 2007-096
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AN AMENDMENT TO THE EMPLOYMENT
AGREEMENT WITH THE CITY MANAGER
WHEREAS, Phillip Oates has been employed as the City Manager since May 1, 2007; and
WHEREAS, the City Manager does not participate in standard employee merit step
increases or COLA as outlined in the Seward City Code, and any increase in pay or annual leave
accrual must be made by an amendment to the employment agreement; and
WHEREAS, Oates' contract states that the City Council agrees to review Oates' salary
annually prior to adoption of the City's fiscal budget. In the first year after his six (6) month review,
Oates shall be entitled to a three (3) percent increase in base salary upon a favorable review by the
Council members as entered on the standard City Manager Evaluation; and
WHEREAS, Phillip Oates is not requesting an increase in pay, only an increase in leave
accrual; and
WHEREAS, per a satisfactory evaluation, the City Council agrees to give the maximum
leave accrual effective pay period beginning January 1, 2008; and
WHEREAS, this increase was already factored into the FY 2008 budget.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Amendment No. 1 to the City Manager's employment agreement dated May 1,
2007 between the City of Seward and Phillip Oates, which increases his annual leave to the
maximum accrual is hereby approved.
Section 2. The effective date of this increase shall be January 1, 2008.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 8~' day
of October, 2007.

BACKGROUND & JUSTIFICATION:
Phillip Oates has been employed by the Seward City Council as the City Manager since May 1, 2007.
The city manager does not participate in standard employee step increases or cost of living
allowances (COLA) as outlined in the Seward City Code, and any increase in pay or annual leave
accrual must be by an amendment to the employment agreement.
The attached resolution reflects an increase in leave accrual only, the increase is the maximum leave
accrual allowed by city code.
CONSISTENCY CHECKLIST:
Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive
Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
