RESOLUTION 2007-120
A RESOLUTION OF THE CITY COUCIL OF THE CITY OF SEWARD, ALASKA,
APPROVING PAYMENT OF $13,090 TO HARMON CONSTRUCTION, INC. FOR
ASBESTOS ABATEMENT IN THE SEWARD MUNICIPAL BUILDING
WHEREAS, an asbestos hazard was discovered during the replacement of the old boiler
system in the Municipal Building; and
WHEREAS, due to the emergent need to replace the boiler prior to the approach of winter,
and the need to abate asbestos in order to protect the safety of employees and workers facilitating
replacement of the boiler, the city manager authorized the emergency abatement in accordance with
Seward City Code 6.10.120 (a) (2), without the use of competitive bids, and utilizing the services of
an abatement team already working in the municipal building to abate asbestos during the remodel of
the State's court; and
WHEREAS, the City administration found it in the City's best interest to utilize the
professional services of Harmon Construction Inc. while they were remodeling another area of the
municipal building.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The City Manager is authorized to pay Harmon Construction Inc $13,090 for the
professional services rendered in the course of asbestos abatement in the Municipal Building.
Section 2. The Seward City Council hereby finds it in the public interest to authorize this
payment in accordance with the emergency procurement provisions of Seward City Code
6.10.120(a)(2), authorizing the waiver of competitive procurement procedures.
Section 3. This resolution shall take affect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 13`" day of
November, 2007.

Agenda Item: After-the-fact Appropriation for Abatement
BACKGROUND & JUSTIFICATION:
The 2007 Operating Budget included $20,000 for the replacement of a vintage boiler in the
Municipal Building. The boiler was purchased and delivered to Sewazd for less than $10,000.
Installation costs aze estimated to be in the $4,000-$6,000 range. While doing a scope of work for the
removal of the old boiler, it became appazent that an assessment for the presence of asbestos would
be prudent. The staff collected samples and sent them to a certified laboratory for analysis. The
results of the testing showed that there was asbestos present in the azea that was associated with the
installation of the new boiler.
Staff utilized the contractor that was in the building doing the remodel for the State Court System, to
make arrangements for the abatement of the asbestos in the boiler room. The State Court System
remodel had required extensive asbestos abatement and it made sense to utilize the same contractor
to abate the asbestos necessary for the boiler installation. A quote was received from the contractor
for a total of $13,090. Staffrecommended to the City Manager that we continue to proceed with the
abatement and boiler installation.
Per the direction of the City Manager, Staff proceeded with the abatement in the boiler room. The
project was completed in less than 5 days, the old boiler safely removed, and the new boiler is
currently in place and being plumbed into the heating system. The new boiler purchase and
installation will not exceed the $20,000 budget. The unanticipated cost of abatement ($13,090) will
need to be funded.

Where applicable, this resolution is consistent with the Sewazd City Code, Charter, Comprehensive
Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.

Funding in the amount of $13,090 for the asbestos abatement will come from within the 2007
Municipal Building budget, account no. 101-1350-5380.

City Council approve Resolution 2007-gyp authorizing the payment of $13,090 to Harmon
Construction Inc. for the abatement of asbestos in the boiler room.
