AN ORDINANCE OF THF. CITY COUNCIL UF'1'HE CITE' OF SEIVARD,
:1LASKA, AUTHORI7.INC AN EXCEP'I'lON TO 5CC 3.65.020 TO PERMIT
RETR0:ICTIVE APPLICATION TO .Il1LY 1, 2UU7 OF PROVISIONS IN A
COLLECTIVE BARGAINING AGRF;F;~IF;N'I' AS .ANll IF :1PPROVED BY
SEPARATE RESOLUTION OF THF. CITY COUNCIL
WHF.RF:AS, over the years, the City of Seward and the International Brotherhood of
Electrical W%orkers, Local 1547, ("1B);W") Lave negotiated and entered into collective bargaining
agreements that provide for wages and certain other terms and conditions of employment for City
employees covered by said agreements; and
11'H F:RF;AS, the last agrcunrcnl between the City and the IBEW expired on .lone 30, 2007,
but remains in force and effect until renewed ur tcnninated; and
~ WHEREAS, representatives of the City and IHE.~U have negotiated in good faith toward a
successor agreement between them, and due to nn fault of either party that agreement was not
tentatively agreed upon or ratified until a date later than ,Tune 31.1, 2UU7, and the parties have weed to
seek ratification acrd approval by the City Council of a three year agreement which by its terms
would commence July 1, 2UU7; and
V4'IIEREAS, SCC 03.1;5.020 does not pcrnrit retroactive changes to wages or working
conditions in a collective bargaining agreement; and
1VHERE:IS, the City administration has requested that the City Council authorize an
exception to SCC 03.65.020 that would allow the ternis of a collective bargaining agreement with a
retroactive effect to July 1, 2007.
THE CITY OP SEIVARD, ALASKA, ORDAINS that:
Section 1. After full review by the City Council of the facts and circumstances of
negotiations for athree-year collective bargaining agreement, it is hereby determined that an
exemption from SCC 03.ti5.020 is warranted ifand to the cllcct tlral the Cily Council approves the
terrrrs of the negotiated collective bargaining agreement between the City and IBEW' presented to it.

Section 2. The provisions of SCC 03.65.020 which prohibit the retroactive effect ofchanges
to wages a~9d working conditions shall not apply to a collective bargaining agreement between the
City and IBL• W for the term .tuly I , 2007 through ,tune 30, 2010, i f said agreement is approved by
separate resolution of the City Council by December 31, 2007.
Section 3. This ordinance shall be anon-code ordinancc.
Srclion 4. This ordinance shall Lake effect immediately.
