CITY OF SEWARD, ALASKA
RESOLUTION 2008-052
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO
ENTER INTO A SOLE SOURCE AGREEMENT WITH EMERALD
ALASKA TO FACILITATE CLEAN UP OF THE
CONTAMINATION SITE AT MILE 3.3 NASH ROAD FOR AN
AMOUNT NOT-TO-EXCEED $65,781.00 AND APPROPRIATING
FUNDS
WHEREAS, The City (Harbor Department) discovered a major contamination
site on May 21, 2008 and began to facilitate the clean-up of this site with assistance from
Emerald Alaska; and
WHEREAS, further clean-up of this site including: site remediation work,
excavation, transportation, and disposal of contaminated soils, and disposal of the
material that was contained in the 24 (55-gallon) drums remains to be completed; and
WHEREAS, analytical results received from the sample collection are required
to be forwarded to the DEC and the EPA and this testing is currently being completed by
~,.,,, Emerald Alaska; and
WHEREAS, Emerald Alaska's personnel are highly trained professionals,
certified in 40-hour Hazwoper, Hazmat, RCRA and DOT regulations and have completed
all of the training requirements cited in 29 CFR 1910.120 and possess fleet equipment
and laboratory facilities required for this job; and
WHEREAS, it is in the best interest of the City to pursue a local vendor within
the State of Alaska who has specialized equipment and remediation services available in
this geographic area; and
WHEREAS, Seward City Code §6.10.120(2), 6.10.120(3) AND 6.10.120(8)
exempt the City from the requirements of competitive procurement procedures where an
emergency makes it unreasonable to delay the purchasing process in order to seek
competitive bids, and the city manager found that postponing this clean up action to
pursue a competitive procurement procedure was not in the City of Seward's best
interest; and
WHEREAS, the City Council finds that it is in public interest to waive the
normal bid process per SCC 6.10.130 to pursue a sole source contract with Emerald
Alaska to excavate, transport and provide ADEC reporting to obtain site closure of an

estimated 20 cubic yards of contaminated soil from 24 drums that were illegally dumped
in the proximity of the City of Seward- on Nash Road for the following: 1) the positive
reputation of Emerald Alaska; 2) the necessity and urgency of site clean-up; 3) the
availability of services; and 4) the recommendation from three professional engineering
firms to utilize Emerald Alaska's services; and
WHEREAS, the project costs will be billed on actual time and materials to
complete the scope of work and based on an estimated 20 cubic yards of contaminated
soil; and
WHEREAS, the estimate does not include any waste disposal; waste disposal
will have to be determined upon review of analytical results; and
WHEREAS, a work estimate was obtained from Emerald Alaska Inc. for a total
of $52,624.91 with a scope of work attached; and
WHEREAS, a twenty five percent contingency has been included for a total of
$65, 781.00 for unforeseen costs; and
WHEREAS, due to the need to expedite the clean-up of this environmental
disaster the city manager recommends sole-sourcing this contract based on the Seward
City Code 6.10.120. .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA that:
Section 1. The city manager is hereby authorized to enter into an agreement in
the form presented at this meeting with Emerald Alaska for an amount not-to-exceed
$65,781.00 and appropriating funds to facilitate clean-up of the contamination site at
Mile 3.3 of Nash Road.
Section 2. Funding in an amount not-to-exceed $65,781 is hereby authorized and
appropriated for this project, from the general fund fund balance account no. 101-0000-
3071-0417 to the SMIC miscellaneous expense account no. 417-4500-5790.
Section 3. This resolution shall take effect immediately upon its adoption.

BACKGROUND & JUSTIFICATION:
On May 21, 2008 a City employee (Harbor department staff) noticed 24 (55-gallon) drums that had
been illegally disposed of on the side of the road at approximately mile 3.3 of Nash Road. The city
manager directed the Harbor department to facilitate clean-up of this site. After obtaining quotes
from several environmental firms around the state, and receiving three recommendations from
environmental engineering firms to utilize Emerald Alaska, the Harbor department hired Emerald
Alaska to sample and survey the contamination site. The results of their sampling revealed that the
drums contained a variety of substances including used oil, antifreeze, hydraulic fluid, and
chlorinated substances.
Fearing further contamination or vandalism of the site, the Harbor department hired Emerald Alaska
to assist Harbor staff to overpack and haul-away the drums on June 3, 2008. The drums are now
stored. and secured in a safe location, until a disposal plan is determined. Further work remains to be
finished at the site to remove contaminated soil and remaining pollutants from the area. Emerald
Alaska's personnel are highly trained professionals, certified in 40-hour Hazwoper, Hazmat, RCRA
