RESOLUTION 2008-081
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A
SOLE SOURCE CONTRACT WITH NORTHSTAR PAVING &
CONSTRUCTION FOR ASPHALT REPAIR AND APPROPRIATING FUNDS
NOT TO EXCEED $160,000 TO ACCOMPLISH EMERGENCY PAVING
AND ROAD REPAIR PROJECT IN THE CITY OF SEWARD
WHEREAS, due to the substantial asphalt deterioration on several City streets it has
become apparent that they need immediate asphalt replacement; and
WHEREAS, there has been a one year delay in utilizing the 1.2 million federal road
improvement ear marked funds; and
WHEREAS, North Star Paving and Construction, Inc, is currently in Seward working
on the Long Term Care Facility; and
WHEREAS, it is in the publics best interest to re-asphalt several locations around the
City in 2008; and
WHEREAS, North Star Paving and Construction, Inc. is willing to perform work for
City road paving improvements at $3.00 per square foot.
WHEREAS, the Seward City Code §6.10.120(a)(5), §6.10.120(a)(8) and §6.10.120(a)(9)
exempts specialized products and professional services from the competitive procurement
process.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. It's in the public's interest to award a sole source contract to North Star Paving
Construction, Inc.
Section 2. The City Manager is hereby authorized to award a sole source contract to North
Star Paving and Construction, Inc. for an amount not-to-exceed $160,000.
Section 3.The amount not to exceed $160,000 is hereby appropriated from the capital
acquisition fund acct no. 103-000-3050 to contracted service account no 103-1030-5390 to pay for
paving services.
Section 4. This resolution shall take effect immediately upon it's adoption.

Agenda Item: Appropriation for Paving
BACKGROUND & JUSTIFICATION:
Deterioration of asphalt pavement on City streets has been substantial in recent years. The City has
experienced asphalt failures on several streets that warrant immediate repair. The Public Works
street crew has patched potholes where appropriate with the asphalt machine. Unfortunately, there
are several streets that are beyond repair with the asphalt machine, and will require new asphalt
pavement. Jesse Lee Drive was scheduled to be refurbished as part of the 1.2 million dollar Federal
Earmark that the City received. The City staff has prepared and submitted a scope of work for the
expenditure of those earmarked funds and the State of Alaska Department of Transportation will be
managing that project. The D.O.T. personnel in charge of managing the road improvement plan
submitted by City Staff, has indicated that it will be 2009 before the project will be initiated.
In the meantime, it is apparent that Jesse Lee Drive needs attention prior to the summer of 2009.
Public Works staff has discussed the possibility of paving, with the sub-contractor doing the paving
for the Long Term Care Facility (North Star Paving & Construction, Inc.). The North Star
superintendent (Jack Foster), has indicated a willingness to pave whatever the City needs, next week
in conjunction with paving projects associated with the LTC. Staffrecommends that Jesse Lee Drive
from Benson to Bear Drive be repaved ($103,000), the Swetman-Bear intersection ($10,000), 7"' and
Railway (approx. $7,500...owner to pay), Tony Bar ($S,000.....water line repair) and AVTEC
Second Ave. facility water line installation ($12,000). These costs are approximate and the City will
pay $3.00 per Sq. Ft. for "actual" Sq. Footage that is paved. This is a very fair price.
This purchase /contract is exempt from competitive procurement procedures under 6.10.120(a)(5)

dealer, or which have a uniform published price.
North Star Paving & Construction, Incorporated is the only company that had the capability and
availability to meet all specifications and equipment requirements for the urgent paving needs within
the City of Seward.
INTENT:
To sole source paving and associated preparation work to North Star Paving & Construction, Inc. for
various areas that need asphalt work within the City of Seward.
CONSISTENCY CHECKLIST:
Where applicable, this resolution/ordinance is consistent with the Seward City Code, Charter,
Comprehensive Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
