PROCLAMATION
WHEREAS, the month of September is designated as `National Alcohol and Drug
Addiction Recovery Month' by the U.S. Department of Health and Human Services; and
c t the WHEREAS, over 22 million people in the United States have faced a substance use
disorder in the past year, and all deserve to experience the many benefits of recovery; and
WHEREAS, this designation is designed to promote awareness of the reality that
addiction and substance abuse is something from which people recover; and
WHEREAS, Recovery Month spotlights the need for alcohol and drug abuse treatment
and recovery, and honors both those in recovery and treatment providers; and
WHEREAS, Recovery Month provides an opportunity to reduce stigma through
education and celebrate the successes of people in recovery; and
WHEREAS, we must recognize the financial savings associated with treatment services,
and ensure that such services are readily available to those who need assistance; and
WHEREAS, cost and insurance barriers present obstacles to those who need access to
treatment facilities and want to re-establish their place in the community; and
WHEREAS, it is critical that we educate our community members and local businesses
that substance use disorders are treatable, yet a serious health care problem, and by taking steps
to address it, as well as provide support for the families and children of those with these
disorders, we can save both lives and dollars; and
WHEREAS, the real hope for recovery lies in early detection and treatment.
NOW THEREFORE, I, Clark Corbridge, Mayor of Seward, Alaska, do hereby proclaim
the month of September 2008 to be
National Alcohol and Drug Addiction Recovery Month
and invite all residents to observe and participate this month. with support, appropriate programs,
activities and ceremonies in the voice of sobriety and recovery.

Subject: Status of the Fort Raymond generator replacement project
Funding:
• $6 Million from bonds
• $2 Million from State (Not received to date)
• $1.5 Million from Electric Department reserves
Items Purchased:
• EMD generators
• Radiators
• Silencers
Project Status:
• Project was bid in April 2008. Costs presented were in excess of $9 Million dollars.
o Since April, we have been working with the proposers, Unit Company and
EPS to reduce the cost to bring it within budget. Phase I (generator
replacement) of the project was estimated at $6.5 Million and Phase II
(warehouse with office space) at $1.5 Million.
o On July 24t", I met with Unit Company and EPS to discuss the new revised
cost. They revised the cost down to $7,150,690.25. This is within our
budget but the scope of work was cut back to what I believed to be
unacceptable level of completion of the original scope.
o I have proposed a new location for the building and new generators that
would not require moving units #4 and #5, saving more than $1 Million
dollars. It is not the optimal location but may be workable.
o Design and specification of the switchgear is a part of the overall project.
We can not order the new switchgear until a contract is awarded. We know
that lead times are long, approximately 42 weeks but we are also optimistic
that lead times will shorten.

NON-CODE ORDINANCE 2008-017
Section 2. The City Council further directs and authorizes the city manager and other City
officers, officials, and employees, as may be appropriate, to register and to complete and file all
necessary reports, forms, and notices relating to election-related expenditures under AS 15.13, or as
may otherwise be required by law.
Section 3. This ordinance shall take effect ten (10) days following enactment.
ENACTED by the City Council of the City of Seward, Alaska, this day of August,
2008.

RECOMMENDATION:
City Council introduce and enact Non-Code Ordinance 2008-017 appropriating funds for the purpose
of possible expenditures to educate the public which could influence the outcome of an election
concerning ballot proposition # 1, which exempts the City of Seward from the State of Alaska Public
Officials Disclosure Law and adopts its own form and guidelines upon passage.

Alaska's campaign finance law does not violate pro-
life association's First Amendment rights because AS
15.13.400(15)'s definition of "electioneering communi-

BACKGROUND & JUSTIFICATION:
The City of Seward has entered into an agreement for the past ten fiscal years to provide dispatch and
clerical services to the Alaska State Troopers and Fish and Wildlife Protection Officers in the
Seward community. The amount of compensation for that contract has been $48,500. The attached
extension would continue the services at the current rate through June 30, 2009.
CONSISTENCY CHECKLIST:
Where applicable, this resolution is consistent with the Seward City Code, Charter, Comprehensive
Plans, Land Use Plans, Strategic Plan and City Council Rules of Procedures.
FISCAL NOTE:

The ARC is listed on the government services contract, and the City is purchasing items from
that very price list. This project was not bid formally by the City of Seward. Seward City Code
purchasing 6.10.120 "Specialized products..." item b states "The city may utilize competitive
bids obtained by other governmental units." We are purchasing skate park elements from this
section of code.

assure the success of this partnership; and
WHEREAS, in 2007, the Friends of the Jesse Lee Home secured a state grant of $1
million for the purpose of immediate stabilization of the Jesse Lee Home; and
WHEREAS, the State of Alaska has appropriated grant funds to the Department of
Natural Resources totaling $1 million; and
WHEREAS, in 2008, the Friends of the Jesse Lee Home secured another $500,000 for
the purpose of immediate stabilization of the Jesse Lee Home; and
WHEREAS, resolution 2008-034 directed the City Manager to accept the $1 million
grant from the Department of Natural Resources and administer a contract to secure services
from a professional to prepare an engineering report; and
WHEREAS, this report will recommend appropriate strategies for rehabilitation,

the Friends of the Jesse Lee Home secured another $500,000 for the purpose of immediate
stabilization of the Jesse Lee Home.
Resolution 2008-034 directed the City Manager to accept the $1 million grant from the
Department of Natural Resources and administer a contract to secure services from a
professional to prepare an engineering report. This report will recommend appropriate strategies
for rehabilitation, development and management of the Home in a manner that recognized the
Jesse Lee Home's historical significance. The report will help outline the most immediate
structural needs, prioritize the highest priorities and provide recommendations for immediate
stabilization to the Friends of the Jesse Lee Home and the City of Seward. The remaining
funding will be used to stabilize the Jesse Lee Home until additional funds are secured.

We appreciate the opportunity to submit our Fee Proposal for Architectural and
Engineering Services required to perform a Structural Stabilization Analysis and a
preliminary Program/Concept Design for the Jesse Lee Home, located in Seward
Alaska. The Fee Proposal was prepared based on our understanding of the required
Scope of Services as outlined in the enclosed document titled "Scope of Services, Fee
Proposal and Preliminary Schedule" dated August 21, 2008.
We propose to perform the work outlined for a total Stipulated Sums of $39,000 for
Phase I and $68, 000 for Phase II. All authorized Expenses as indicated shall be
reimbursed at cost plus 10 percent, and not to exceed $1,500
We have also enclosed an anticipated schedule to perform each phase of the work. The
total calendar time required to perform the work will be determined by the amount of
days necessary for review and comment, final program approval, scheduled
presentation, and community feed-back. We will work with the City of Seward and the
Friends for Jesse Lee Home to help expedite the overall schedule.

or changes thereto. This date is not necessarily the Completion Date as described in 5.0
Completion Date. This Agreement may be amended only in writing and upon compliance with
all applicable statutes, ordinances, and regulations.
3.0 FEES. The proposed fee of $108,500 is accepted by the City. The Contractor shall invoice the
City monthly upon percentage of completion of each phase of work according to the fee schedule
in Exhibit A. Upon the City's satisfaction with progress of each Phase of work and agreement
with the invoice, the City agrees to make payment to the Contractor within 30 days following
receipt of such invoice.
4.0 SCOPE OF SERVICES. The City and Contractor have agreed upon a scope of work described
in the Contractor's proposal, Exhibit A, to provide professional architectural design services.
This Scope of Services can only be changed in writing pursuant to Section 26.0 of this
Agreement.
5.0 SCHEDULE FOR COMPLETION. The schedule for completion of all work described herein
shall be as follows: 145 working days and as outlined in Exhibit A. For good cause shown, the
Contracting Office may approve requests for extension of time where no change in fees or scope
of work is requested.
6.0 PERSONNEL/ORGANIZATION
6.1 Key Personnel. Work and services provided by the Contractor will be performed by:
Mark A. Kneedler, AIA and David L. Moore, AIA and assigned staff.
6.2 Changes in Key Personnel. The Contractor shall give the City reasonable advance notice
of any necessary substitution or change of key personnel and shall submit justification
therefore in sufficient detail to permit the City to evaluate the impact of such substitution
on this Agreement. No substitutions or other changes shall be made without the written
consent of the City.
7.0 STANDARD OF PERFORMANCE. The Contractor agrees to provide all required professional
services to complete the project and any additions or changes thereto. The Contractor accepts the
relationship of trust and confidence established between it and the City by this Agreement. The
Contractor covenants with the City to furnish its best skill and judgment, and to further the
interest of the City at all times through efficient business administration and management. The
Contractor shall provide all services in a competent manner. It is understood that some of the
services to be rendered hereunder required professional judgment and skill. In those cases, the
Contractor agrees to adhere to the standards of the applicable profession.
The Contractor further covenants and agrees that the tasks outlined in Exhibit A will be done to
the complete satisfaction of the City, and in accordance with the laws of the State of Alaska and
the City of Seward. It is specifically understood and agreed that no claim for additional work or
materials, done or furnished by the Contractor and not specifically provided for herein, will be
allowed by the Contracting Officer, nor shall the Contractor do any work or furnish any material
not covered by this Contract, unless such work is ordered in writing by the Contracting Officer.
8.0 TIMELINESS OF PERFORMANCE. Time is of the essence in this Agreement. Contractor's
failure to meet any such deadlines or required performance may adversely imperil other
contractual obligations of the City.

Property Damage. Coverage shall include the following extensions: (A) Contractual Liability;
(B) Products and Completed Operations; (C) Independent Contractors Coverage; (D) Broad Form
General Liability Extensions or equivalent; (E) Deletion of all Explosion, Collapse and
Underground (XCU) Exclusions, if applicable; (F) Per contract aggregate.
The Contractor shall procure and maintain during the life of this contract, Professional Liability
- Errors and Omissions Insurance in an amount not less than one million dollars ($1,000,000)
aggregate to protect the Contractor from any claims or damages for any error, omission, or
negligence of the Contractor, the Contractor's firm, employees or subcontractors (which results in
a financial loss to the City).
The Contractor shall procure and maintain during the life of this contract Motor Vehicle &
Equipment Insurance, including applicable No-Fault coverages, with limits of liability not less
than one million dollars ($1,000,000) combined single limit Bodily Injury and Property Damage
coverage. Coverage shall include all owned vehicles, all non-owned vehicles, and all hired
vehicles.
The Contractor shall provide the City of Seward at the time contracts are returned for execution,
Certificates of Insurance and/or policies, acceptable to the City of Seward, as listed below:
a. One (1) copy of Certificate of Insurance for Worker's Compensation Insurance;
b. One (1) copy of Certificate of Insurance for Commercial General Liability
Insurance;
c. One (1) copy of Certificate of Insurance for Vehicle & Equipment Insurance;
d. One (1) copy of Certificate of Insurance for Professional Liability-Errors and
Omissions Insurance
e. If so requested, Certified Copies of all policies shall be furnished.
12.0 GOVERNING LAW. The laws of Alaska will determine the interpretation, performance and
enforcement of this Agreement.
13.0 OWNERSHIP OF WORK PRODUCTS. Payment to the Contractor for services hereunder
include full compensation for all work products and other materials produced by the Contractor
and its subcontractors pertaining to this Agreement.
The originals of all material prepared or developed by the Contractor or its employees, agents, or
representatives hereunder, including documents, drawings, designs, calculations, maps, sketches,
notes, reports, data, models, computer tapes, and samples shall become the property of the City
when prepared, whether delivered or not, and shall, together with any materials furnished the
Contractor and its employees, agents, or representatives by the City hereunder, be delivered to the
City upon request and, upon termination or completion of this Agreement. Materials previously
created and copyrighted by the Contractor included in this project will remain property of the
Contractor. Copies will be made available to the City upon request. Materials purchased from
and copyrighted by third parties are not included in this provision.
14.0 PATENTS, TRADEMARKS:.. AND COPYRIGHTS. The Contractor agrees to defend,
indemnify, and save the City harmless from and against any and all claims, costs, royalties,
damages and expenses of any kind of nature whatsoever (including attorneys' fees) which may
arise out of or result from or be reasonably incurred in contesting any claim that the methods,
processes, or acts employed by the Contractor or its employees in connection with the

The Contractor shall take affirmative action required by law to ensure that applicants are
employed and that employees are treated during employment without regard to their race, color,
religion, national origin, ancestry, age, or marital status.
19.0 NO ASSIGNMENT OR DELEGATION. The Contractor may not assign, subcontract or
delegate this Agreement, or any part of it, or any right to any of the money to be paid under it
without written consent of the Contracting Officer.
20.0 INDEPENDENT CONTRACTOR. The Contractor shall be an independent contractor in the
performance of the work under this Agreement, and shall not be an employee or agent of the City.
21.0 PAYMENT OF TAXES. As a condition of performance of this Agreement, the Contractor shall
pay all federal, state and local taxes incurred by the Contractor and shall require their payment by
any other persons in the performance of this Agreement.
22.0 PRECEDENCE AND DIVISIBILITY. The provisions of this Agreement shall fully govern the
services performed by the Contractor. If any term, condition, or provision of this Agreement is
declared void or unenforceable, or limited in its application or effect, such event shall not affect
any other provisions hereof and all other provisions shall remain fully enforceable.
23.0 ENTIRE AGREEMENT. This Agreement contains the entire agreement between the parties as
to the services to be rendered by the Contractor. All previous or concurrent agreements,
representations, warranties, promises, and conditions relating to the subject matter of this
Agreement are superseded by this Agreement.
24.0 COMPLETION OF WORK, TERM OF AGREEMENT. The Contractor shall perform all
work in a timely fashion, and in accordance with the schedules included in this Agreement and
Exhibits.
25.0 CLAIMS AND DISPUTES. Venue for all claims and disputes under this Agreement, if not
otherwise resolved by the parties, shall be in the appropriate Alaska State court in Anchorage,
Alaska.
26.0 CHANGES IN SCOPE OF WORK.
26.1 General. No claim for additional services not specifically provided in this Agreement
will be allowed, nor may the Contractor do any work or furnish any materials not covered
by the Agreement unless the work or material is ordered in writing by the Contracting
Officer. Preparation of Change Orders and design changes, due to errors and/or
omissions by the Contractor, will be done at the sole expense of the Contractor.
26.2 Changes in Scope of Work. The City or its representative may, at any time, by a written
Change Order delivered to the Contractor, make changes to the scope of work, or
authorize additional work outside the scope of work. Within 30 days, the City and the
Contractor agree to negotiate additional work to be included in this Agreement, to be
performed as Change Orders.
26.3 Compensation to the Contractor. If any Change Order for which compensation is
allowed under this Article causes an increase or decrease in the estimated cost of, or time
required for, the performance of any part of the work under this Agreement, or if such
change otherwise affects other provisions of this Agreement, an equitable adjustment will
be negotiated. Such an adjustment may be:

counseling and other opportunities. This program was aimed at health and safety issues,
discouraging substance abuse, depression and neglect issues, promoting citizenship and more. Bond
stated youth needed a place that provided the tools to make a difference in their lives.
Al Lynch, Technical Sales Manager for TelAlaska Systems, had full confidence in
TelAlaska's VOIP/PBX phone system. It had greatly increased the efficiency of TelAlaska when it
was installed there, and he assured it would do the same for the City. Lynch pointed out the local
support to stand behind it.
Anita Schoening, was in support of the Boys and Girls Club. Her research thought it cost
$40 a year for her child to be in this club. This program was financially great, in a good location and
was safe. Other after-school places were too expensive. She was speaking for other people that
could not afford some of those after-school programs. Schoenin ~ thought this chub was needed.
Brenda Ahlberg, Executive Director of the Boys & Girls Club on the Peninsula, thanked the
council for what she thought were benefits of youth of Seward. She further thanked Vice-Mayor
Dunham for the task force suggestion to cooperate betweenprograms ` Ahlberg stated with declining
federal dollars, she appreciated the city's foresight and investment in the club.
Father Emmanual Williamson, was a sponsor for the foster program. He supported the
Boys & Girls Club and thought it was important to support all avenues for children to give them a
positive environment, and urged council support fbr this resolution.
Pastor Peyton Sparks, also spoke in support of the Boys & Girls Club. He thought many
children benefited from this program and he could see a difference in his own children from the
after-school hour tutoring. Sparks stated it would be a detriment to the children in this town if this
club were to lose their funding.
Elizabeth Grace, was new to Seward and a single mom. In working hard to take care of her
girls, she stated thz Boys & Girls Club ~~as ~a good fit. She felt children needed to be kept with other
children their own age and-have plenty of supervision. With different learning abilities between ages
she didn't. feel it was safe to put those peer .groups together. Grace liked the structured environment
of the club and the way they did their homework and how they prepared the children for the next day.
She was grateful for the program.

City Manager's Report. City 1V~~nager Phillip Oates stated there were still vacancies on
the Planning & Zoning Commission and the Historic Preservation Commission. Friday was the
deadline to turn in candidate packets for ~ city council position.
Oates stated that since the City la+d implemented the wellness plan, the health insurance
claims had reduced in frequency and severity. He noted that Assistant City Manager Kirsten Vesel
was recently appointed by the Governor for the State of Alaska Community Service Commission. In
answering an earlier question, the Sealife Center had removed the engraved bricks because of safety
concerns and had not developed a plan for display of the bricks. Oates also noted after recent
meetings regarding tsunami readiness, it appeared the City should be conservative on deciding what
infrastructure and use of the new land would occur in the southeast area of the small boat harbor.
^ Harbor. The 53rd Seward Silver Salmon Derbv was underway and the staff had
logged approximately 850 vessels in the harbor. Clean-up efforts on the illegally

^ Public Works. The library, city hall and 4th Avenue AVTEC sidewalk repairs were
completed and a scope of work for ADA parking at city hall was being developed.
The City was continuing to repair potholes with the infrared machine and water line
upgrades were being coordinating at the Second Avenue AVTEC facility.
^ Park & Rec. The Hoben lark fountain was removed and the new fountain basin
would be placed Wednesd~:y, ~~eather permitting. A skate park upgrade grant from
American Ramp Company was acquired.
In response to questions, Oates stated it was a fairly complex matter to address maintenance
access issues and bring power across Japp Creek, but the city was doing all it could to facilitate the
request from AT&T for their cell--phone tower.
City Attorney's Report. Cheryl brooking reported from June 21 through July 20, 2008.
The firm continued to provide advice on; contracts, resolutions, ordinances, continued fees for
common carriers, administrative matters, proposed leases, etc. There were Long Term Care Facility
issues, land use and employment issues, and advice given on flood management. Brooking stated the
harbor issues amounted to land use in the harbor and illegal dumping and clean-up. She stated there
were attempts from both sides to reach a settlement on the Resurrection Bay Conservation Alliance
litigation, and they had closed on approximately $6 million dollars of revenue bonds for generator
upgrades.
A Presentation By Beth HIein Vas Given For Big Brothers And Big Sisters. Beth Klein,
Community Coordinator requested support from the city for the Big Brothers and Big Sisters
program to continue to serve the existing program in Seward. This program served children ages 6
to 18 and was different from other programs because it developed lifelong friendships.

Oates anticipated having all permits in hand from the Corps of Engineers within 60 days
since all agencies-:were now in agreement. Negotiations for property acquisitions would begin. Wm.
J. Nelson & Associates firm managed the engineering and consulting services for the city, and would
oversee the property negotiations and appraisal services. Oates stated the levee footprint was for
approximately 24 pa~cds for at an estimated cost of $75,000 by a third party appraisal firm, property
negotiation and acquisition services conducted by HDR, Inc. for $95,000, including a 10°Io
contingency for a total not to exceed $187,000. Funds available for this project were: $1.7 million in
RCS funding which could not be used for property purchase matters, $2.6 million from State of
Alaska, $250,000 from the City of Seward for bedload maintenance, for a total of $4.55 million
dollars. Oates anticipated full and some partial acquisitions of land costing $750,000 to $1 million
dollars. He explained that a firm like HDR was needed because of the complexity of the project and
the strict land acquisition requirements that needed to be followed because of federal dollars used.

Oates stated the city received their current phone system in 1994. In 2000, a major upgrade
occurred taking the system to the maximum limit. The current system had reached its limits and was
failing. Oates stated the new system would be cost effective and efficient Auld would include the
hospital and the Long Term Care Facility. Contingency was set at a High 40% because of the
unknowns of the new facility and increases in cost and technology by next year. Oates presented one
advantage with incorporating the system into the Long Term Care Facility was the city could re-coup
the costs through the bonding. Monthly costs would be much cheaper, thus would more than pay for
itself after initial installation costs.
Management Information Systems Director Mike Meeks thought the city should recoup
the installation costs within 10 years.
The Rules Were Suspended By Unanimous Consent To Allow Al Lynch, Technical Sales
Manager For TelAlaska To Answer Questions.
Dunham did not want to pay maintenance on construction and voiced concern with long-
term maintenance agreements.
Oates stated all equipment would be purchased at one time. The warranty would be for 12
months once purchased'then a maintenance agrc~ment would be paid for any degradation of the
service. He stated monthly maintenance was a-valid cost.
Amberg was concerned that the 40% contingency was excessive. She thought it was a good
idea to bring contingency information back before the city council so the public knew where the
costs went.

Oates stated he was willing to justify any contingency costs, but hoped to just report back to

the unknowns with this telephone installment project.

Home Energy Rebate, Weatherization, and Loan Programs

General Information
AHFC now has three programs to help Alaskans reduce energy bills on their homes.
The objective of these programs is to make a home more energy efficient.
Under the Home Energy Rebate Program, homeowners who want to make their own
energy-efficiency improvements on their home can receive a rebate for some or all
of their expenditures. The Home Energy Rebate Program has no income
requirements. See more below.
The second program is the expanded Weatherization Program, available to Alaskans
who meet certain income and eligibility guidelines.

The third program is the Second Mort~age_Pro_ ram for_Ener~~Conser_v_aton.
Borrowers apply to AHFC for financing to make cost-effective energy
improvements on owner-occupied properties.
The Home Energy Rebate Program
The rebate program assists homeowners in making the best energy-efficiency
improvements for their home. The program requires a certified home energy rater
to evaluate homes before and after the improvements. The more a home's energy
efficiency improves, the greater the possible rebate. New! The time limit to apply
for the rebate has been extended to 18 months from the date of the initial As-Is
energy rating.
As of May 16, 2008, AHFC is accepting AkWarmT"' Energy Ratings performed by
AkWarmT""-certified energy raters for the Home Energy Rebate program.

Due to the overwhelming popularity of this program, energy raters have been
overwhelmed. Training is underway for more raters, so the backlog should
ease in the near future.
The cost of these ratings, performed after May 15, 2008, are covered by AHFC and
paid directly to the homeowner, up to a combined total of $500 ($325 for the as-is
rating and $175 for the post-improvement rating).

Borrowers apply to AHFC for financing to make cost-effective energy
improvements on owner-occupied properties. Borrowers select from the list of
energy upgrades included with the energy audit of their home, performed by
an AKWQrmT"' certified energy rater.
