CALL TO ORDER
The September 7, 2010 Special Meeting of the Seward City Council was called to order at
6:00 p.m. by Mayor Willard E. Dunham.
OPENING CEREMONY
City Manager Phillip Oates led the pledge of allegiance to the flag.

David Dieckgraeff mentioned that the Senior Center was providing free lunches for veterans
beginning September 1, 2010.

NEW BUSINESS
RESOLUTION 2010 -082, Authorizing A Sole Source Contract With Metco, Inc. In An
Amount Not To Exceed $237,300, To Supply And Install 36" Culverts And Manholes Under
And Adjacent To Approximately 700' Of Alaska Railroad Track, In Conjunction With
Construction Of The North Forest Acres Levee /Road Project, And Appropriating Funds.

Oates stated the code authorized an exemption to the bidding process if the delay was
reasonable and an emergency. He had spoke to the city attorney who thought it appropriate to sole

source once reasons below were outlined. He noted the tight construction schedule and not sufficient
time to order materials. Oates reminded that the time crunch was because of delays in this project .r
such as timelines, hardship in obtaining materials and acquisition of properties. This portion of the
project was originally estimated in excess of $400,000. The Alaska Railroad offered to cut the track
as long as the project could be completed within a 48 hour time frame because of train schedules.
The culvert was purchased from Mississippi. The availability of pipe, coordination with the railroad
and timeline considerations came together for this short timeframe. Oates thought it was important
to have a local contractor for flexibility because of weather, change of railroad schedule, etc. Oates
explained the complex culvert project and the need for redundancy of equipment, the need for the
right people on site, and the care to avoid cutting fiber optic cable that must be available within this
48 -hour period. Since the original estimate was over $400,000 he thought this price was appropriate.
In response to Valdatta, Finance Director Kristin Erchinger answered there was about
$400,000 left from the grant and all the money must be spent by June 30, 2011.
Rules were unanimously suspended to allow David Dieckgraeff of Metco, Inc. to speak
that heavy freeze would be the weather that could hamper the 48 hour period.
Keil thought the facts warranted an emergency and the need for sole sourcing this contract.

COUNCILS' COMMENTS ..
Oates stated rock was produced, the culvert would be completed, and a fair price for gravel
would help the bedloading problem, with phone line work also being elevated to road grade. The
last two remaining pieces to the project was the imminent domain issue and to build the levee road.
Valdatta said the harbor wasn't flushing itself and wasn't sure there was enough tidal action
with the new breakwater. He suggested culverts with gates.
Keil wanted the Mayor to contact the church in Florida and condemn burning of the Koran on
September 11 because they were putting the troops in danger. She knew it was a national issue and
wanted the politicians to know this wasn't appropriate.
