ADJOURNMENT City of Seward, Alaska Council Agenda March 23, 2015 Page 3 PROCLAMATION WHEREAS, on July 26, 1915, Leon Urbach left his position at Seward Commercial Co. and opened Urbach's Clothier; and WHEREAS, Leon carried everything in the store - from groceries to clothing - and finally settled on carrying clothes for the working man; and WHEREAS, Leon married in 1919 and had two sons; his son, Larry, married Dorothy Weil in 1950; and WHEREAS, when Leon retired in 1954, Larry and Dorothy took over the store; and WHEREAS, Urbach's store survived the 1941 arcade fire on Fourth Avenue, and the 1964 earthquake and tsunamis; and WHEREAS, Urbach's remains a jewel of a store with its original wood flooring and its old 1908 National brass cash register; and WHEREAS, today, Dorothy runs the store with her daughter, Susan, as the second and third generation owners; and WHEREAS, in celebration of their 100th Anniversary, Urbach's is offering weekly specials all year long in appreciation of all their loyal customers. Box 167 Telephone (907) 224-4047 Seward, AK 99664 Facsimile (907) 224-4038 MANAGER'S REPORT March 23, 2015 The following purchase orders for between $10,000 and $50,000 have been approved by the City Manager since the last council meeting: • Different Strokes - $10,259.62—Repair Lineman's truck • Power Solutions - $ 13,398.00—Batteries to support the emergency start of the switch gear for Fort Raymond Generators. Both issued through the Electric Department A. Administration: (1) Meetings with Mayor. (2) Open Houses have been hosted for both Senator Pete Micciche and Speaker Mike Chenault. (3) AIDEA/SMIC development teleconference and document gathering. (4) Personnel meetings and interviews for open positions. B. Public Works: (1) Streets • PO for $9,000 to repair the Lowell Creek Bridge, the parts have been ordered and shipping is being coordinated. • Drainage improvements are being planned for staff to complete prior to the Federal Earmark paving. (2) Water/Wastewater: • Began draining the Spring Creek lagoon and ADEC has been notified. Merrell Brothers equipment was scheduled to arrive the week of March 16t. The sludge removal and disposal project is running on schedule. (3) Admin: • North Seward Water Storage Tank bid has been publicly noticed and will close April 14th, 2015. Maple Street Sewer and Water will be bid separately but may be completed concurrently, saving money for the project and taxpayers. • Quotes are being solicited for the Certification of Right of Ways. • Staff is planning to prepare a resolution for approval and appropriating water reserve funds for added alternates to the North Seward Water Storage Tank project for an additional well and standby generation. • Continuing to complete FEMA projects (Barwell St, Phoenix Blvd, Dieckgraeff Rd, Lowell Creek Ped Bridge) C. Fire Department: The Fire Department will issue an RFP to perform a Level II Refurbishment as outlined in NFPA 1912 Fire Apparatus Refurbishing, 2011 Edition. The apparatus is a 1985 E-One Engine, 4 wheel drive, 500 gallon water tank with a 1500 GPM Hale pump. The scoring criteria will be presented as a lay down supplement to this CMR. D. Finance Department: The City's annual financial audit is scheduled to begin March 30 and will involve two weeks on-site. As discussed with the City Council, the finance department will bring forward a request to Council to upgrade one existing position to an Assistant Finance Director, as required by the City Code, but that will not take place until after the audit. 5 E. Electric: (1) The electric department is dedicating time to counting inventory and entering it into the new inventory software and continuing to move into the new warehouse. We are reorganizing all the materials and disposing of items that are no longer useable. (2) Our thanks to the parks and rec department for their continued assistance with the heavy lifting and moving into the new warehouse. (3) We have released a request for bids for re-conductoring Camelot and they are due on 3/20/15. (4) An RFP for the meter reading contract has been released. Those proposals are due on 4/20/15. Judging criteria are as follows: Understanding of Work 25% or 25 points Qualifications 25% or 25 points References 25%or 25 points Proposal Price 25%or 25 points Total 100%or 100 points (5) Project Management Report: Contract C15-005 (AEA Grant 7910011): • A Notice To Proceed has been issued to Electric Power Constructors (EPC) on February 17, 2015 for their construction contract to relocate two generators and construct infrastructure upgrades at the Fort Raymond substation. • EPC has initiated early stages of coordination for the project. EPC will review and recommend approval for the 5kV switchgear manufacture. EPC will coordinate with Valley Power Systems (VPS) for engine upgrades during the construction schedule. • "Owner supplied materials" continue to be purchased for this project. The replacement battery bank order should be submitted by late March and will complete the project defined owner purchased material requirement. • EPC's Construction Schedule is under development and mobilization is planned for the second week in April. F. Harbor: (1) During the week of March 3-7 and before the bad weather arrived, we tested the new 330 ton boat lift and we also used it for two actual lifts. (2) The harbor has updated its Stormwater Pollution Prevention Plan SWPPP and it will be submitted early in April. (3) Harmon Construction is working with the Harbor's engineer to trim the budget for the fish cleaning station project. (4) Leaseholders have been notified of the new rental rates that take effect July 1. (5) Staff has reviewed the preliminary plans for the B, C, S Dock Replacement Project. The 95% design is expected later this month. G. Proposals and comments of references will be evaluated to ascertain which proposer best meets the needs of the City.The evaluation will be conducted by a committee as selected by the Electric Utility Manager. The technical factors to be considered during the evaluation are as follows: a. The proposal's responsiveness in clearly stating the understanding of the work to be performed as described in Section 11-Proposal Preparation Requirements. b. The proposer's experience with reading electrical meters in Seward and/or other similar electric utilities. c. All proposers which are deemed qualified to perform the engagement in the manner specified in this RFP will be further rated on the proposal/fee schedule proposal (Attachment A)which was submitted in a separate envelope. Any proposer deemed unqualified will receive their proposal/fee schedule proposal back unopened. d. Weighted Criteria -The criteria considered during the evaluations of the proposals and the associated scoring are as follows. i. Understanding of Work 25%or 25 points ii. Meeting Date: March 23, 2015 To: City Council Through: Jim Hunt, City Manager gtASwp Ron Long, Assistant City Manager From: Donna Glenz, Planner Agenda Item: Resolution 2015- 0(1 recommending City Council and Kenai Peninsula Borough approval of the Fourth of July Creek Subdivision, Seward Marine Industrial Center, Raibow Replat BACKGROUND & JUSTIFICATION: Attached for the Council's review and recommendation to the Kenai Peninsula Borough Planning Commission is a preliminary plat submitted by Cline and Associates on behalf of Dave Phillips, Raibow Fiberglass & Boat Repair, LLC. In accordance with Seward City Code (SCC) 16.01.015(B) "No preliminary plat of City-owned property may be submitted to the Kenai Peninsula Borough Planning Commission for approval without the prior consent of the City." This replat is located within the Seward Marine Industrial Center (SMIC). This platting action subdivides the un-subdivided remainder of Block 4, Fourth of July Creek Subdivision, SMIC, Plat 2000-6 creating two (2) parcels to be known as Lot 2 and Lot 3, Block 4, involving approximately 12.25 acres. The new Lot 3 will be under a long-term lease to Raibow Fiberglass & Boat Repair, LLC. The second action in this replat subdivides Lot 4A, Block 7, Fourth of July Creek Subdivision, SMIC, Plat 2014-17; creating two (2)parcels to be known as Lot 4D and Lot 4A-1; involving approximately 11 acres. SUBDIVISION REVIEW: Zoning: The replat is within the Industrial Zoning District. Development surrounding this replat includes the Vigor Alaska, Communications North and the City boat storage yard parcels. Utilities: The replat area is currently serviced by private roads, some municipal water, sewer, electric and other utilities are available; no subdivision installation agreement shall be required. The surveyor has worked diligently with City staff to provide current and planned utility/access easements. Existing Uses: Block 4 currently contains the private Lot 1 A, owned by Pat Marrs, Communications North. Public Comment: Lease holders within three hundred (300) feet of the proposed platting action were notified of the public hearing. Public notice signs were posted on the property and all other public hearing requirements of Seward City Code §15.01.040 were complied with. At the time of the Public Hearing before the Planning and Zoning Commission two (2) public inquiries were received, one was requesting a digital copy of the plat and the other a clarification on the location of the new parcels. No other concerns were received. Kenai Peninsula Housing Initiatives (KPHI)Request to Seward City Council For Donation of Portion of Pat Williams Park for use to develop Independent Senior Housing In the mid 1990's, the communities of Kenai Peninsula participated in a series of meetings called "Healthy Communities" where, with consultants, each community broadly defined their quality of life issues. Consistently throughout this process, the severe lack of safe affordable housing emerged as a significant community and economic development issue. This led community and business leaders to collaborate on solutions. As a result, Kenai Peninsula Housing Initiatives, Inc. (KPHI) was formed — a private non-profit with the mission to alleviate the critical need for affordable housing across the entire Kenai Peninsula. Early on, KPHI provided information, referrals, and advocacy. In 2000 KPHI acquired its first property - a HUD repossessed home in Soldotna. In 2002, KPHI earned recognition as a Community Housing Development Organization (CHDO) and received its' first development grant for a special needs housing project in Homer. With CHDO status KPHI received a five-year operating grant which enabled the hiring of KPHI's first staff person in 2003. In 2004 the organization completed Brookside Special Needs Housing in Homer and renovated the HUD home and sold to a low income family. The organization has developed a new property every year since. Under the leadership of Executive Director Steven Rouse and with the commitment of a highly accomplished staff, in 12 years KPHI has successfully developed 105 units of affordable housing and owns and manages 83 of those units. Additionally, KPHI acquired 17 units of housing from Peninsula Community Health Services and manages those as well. In 2011, KPHI bought 5 Kenai Peninsula single family homes in foreclosure, remodeled 4 and returned to property tax rolls by selling to low income families under the Neighborhood Stabilization Program. In total KPHI has an inventory of 102 rental units servicing low income, senior or special needs populations. /- 11 Page Kenai Peninsula Housing Initiatives( KPHI) 2 Request for Donation of a portion of Pat Williams Park for Senior Housing Development After assuming management of the South Peninsula Homeless Prevention Program in 2007 and applying strict guidelines and reporting protocols, the program attracted funds from 2008 to mid-2012 that allowed KPHI to assist over 300 individuals annually to maintain their housing. In October 2012 KPHI transferred the program to Haven House secure in knowing the program was financially strong and under capable new administration. KPHI continues to work on new initiatives aimed at filling holes in the continuum of housing on the Kenai Peninsula. It is with that objective in mind that KPHI has been working since 2007 to fulfill the need for independent senior housing in Seward. Independent market studies commissioned by Alaska Housing Finance Corporation and local knowledge have identified a need for senior housing in this community. Efforts by KPHI to develop such housing have been stalled by the inability to acquire suitable land for development. A local task of concerned citizens was formed almost a year ago to address the lack of independent senior housing and tireless effort has been given to exploring options. It is with that experience empowered by the awareness of the urgent need that KPHI formed a working partnership with this task force to finally succeed in developing housing that does not exist and can become a reality with the City of Seward's assistance. Currently, the main source of gap/subsidy funding ( the difference between Total Project Costs and all other funding sources- i.e. debt, cash, donation) for construction of independent senior housing in Alaska is the Senior Citizens Housing Development Funds Program (SCHDF) administered by Alaska Housing Finance Corporation. Annually AHFC accepts pre-applications for proposed projects. Based on scope and KPHI provides the low-income, very low-income,senior and special needs residents of the Kenai Peninsula area the opportunity to take a more active role in their lives and communities by providing a variety of affordable housing options. EIN 91-1823180 Kenai Peninsula Housing Initiatives( KPHI) 3 Request for Donation of a portion of Pat Williams Park for Senior Housing Development strength of a proposed project AHFC commissions an independent market study to support need for the housing type and then, if deemed worthy, invites the pre-applicant to submit a full application. The pre-application process starts in April /May of each year with full application deadline usually in November and notice of grant award by year end. Construction usually commences the following summer. Due to statewide need and limited funding, the SCHDF approves only few projects each year and competition is always fierce. Project proposals are awarded points for community involvement and leverage contribution to the overall project cost and more points based on the ratio of grant funds to Total Project Cost. Under these criteria a common and effective method to secure a high number of points and win a grant award is for the site to be donated. In order for the first step in the time line (pre-application) to be successful and thus lead to a funded project, KPHI must demonstrate "site control" for the proposed location of the development. Site control need only be a letter of commitment (resolution) that describes "should the project receive construction grant funding, clear title to the subject property will be provided/donated for project use". In simple terms, ownership of the property is retained until the project is approved and funded by AHFC. If the proposed project is not funded, the agreement to donate property is rendered void. In spring 2015, KPHI seeks to submit a preliminary application to the Alaska Housing Finance Corporation Senior Citizens Housing Development Funds Program for the development of 5- 6 units of independent senior housing in Seward. This would be the first phase of a planned use development that is designed to include a second phase development in 2018 or 2019. The attached resolution reflects a 7%increase to Kinney's salary,to$72,443.28 annually,reflecting the outcome of a satisfactory annual evaluation by the Seward City Council, which took place on February 23 and 24, 2015. During the budget process,the administration typically makes no judgment about pay changes for the City Clerk,as it is sometimes uncomfortable for the clerk to justify budgeting for a pay raise that will later require an evaluation and a contract negotiation. Therefore,this adjustment was not included in the 2015 Budget. The attached resolution appropriates the additional salary and benefits necessary to accommodate a 7% pay increase which will affect the 2015 budget. He stated only hiring or rehiring employees not using marijuana in the last 30 days did not ensure a safe and productive drug free environment. Hearn shared that he was first hired by the United States Postal Service in 1967 on a seasonal interim. He was hired a total of six times until he joined the postal service full time in 1979. Hearn stated he would have never passed a drug test for marijuana during any of these hiring periods. When he retired in 2005, he had accrued over one year of sick leave,and he was never hurt or injured on the job.Hearn felt revising the policy was not in the best interest of the city; he hoped council didn't rubber stamp this resolution tonight. He reminded council that the voters of Seward passed the ballot measure to legalize the use of recreational marijuana. Jody Tuck,Chair of the Seward Recreation Committee,thanked the council for increasing their number of members to seven.Tuck reported on three different action teams the committee was working on: 1) improvement of the community events calendar,2)bringing an ice rink to Seward, and 3)winter recreation and promoting Seward.Tuck stated since the community event calendar was now successfully launched through the Chamber,that action team would likely disband; however they were seeking volunteers to work on this website. Tim McDonald took a tour of the RN Sikuliaq and found it to be a great tour.The amazing thing about the vessel was the cutting edge technology.He asked if they could scan the bay to show mapping of the earthquake damage. The Sikuliaq had ground penetrating radar, which might be helpful for developing the Seward Marine Industrial Center(SMIC). Sue McClure reported the assembly had a long meeting on February 24, 2015 where they heard many hours of public testimony on a proposed ordinance to prohibit commercial cultivation of marijuana outside of city limits in the borough. The ordinance was ultimately defeated.McClure stated many had concerns with making policy before the state was finished making their laws on recreational marijuana use and cultivation.A resolution would soon be coming to the assembly to join a task force with other communities in the borough regarding marijuana legalization. McClure expended much testimony at their upcoming March 17, 2015 meeting over repealing the seasonal sales tax exemption on non-prepared foods in the borough.The thought behind this ordinance was to put the lost money from the sales tax exemption back to the schools, which borough sales tax was dedicated to. There was also a substitution ordinance on the City of Seward,Alaska City Council Minutes March 9, 2015 Volume 39, Page table to amend the exemption to a six month period instead of the current nine month period. McClure said the assembly was also considering an ordinance sponsored by her and the mayor to allocate$50,000 to the City of Seward to craft a new comprehensive plan.The assembly will also be approving a new member to the Seward Bear Creek Flood Service Area Board. City Manager's Report. Assistant and Acting City Manager Ron Long referred to the written report in the packet,and noted a new harbor report was laid down before the council. Public Works Director W.C. Casey gave a brief update on the sludge removal project. Merrell Brothers' equipment was on the barge and was expected to arrive in the state next week. Staff was scheduling some additional aeration and dosed the pond with extra calcium nitrate per some new reports of odors coming from the lagoon. Dissolved oxygen levels were exceeding nine parts per million,which was good but not unusual for this year. Council and the public were always welcome to contact him for any updates. Merrell Brothers applied for a land use permit for sludge disposal and a decision on that permit was expected by the end of this month, so no work on the project was expected to take place until the end of this month. Long congratulated Planning Technician Dwayne Atwood for completing an advance flood plain management course by FEMA.Last week,Long attended had a kick-off of a series of meetings in Seward with Arcadis Consultants and the Alaska Industrial Development and Export Authority (AIDEA)for the Seward Marine Industrial Center(SMIC)expansion project.These initial meetings and questions will generate more meetings and questions.The next step was to compile information and host some public meetings on the SMIC expansion project. In response to Terry, Long stated the recent power outage was a result of a tree caught in a power line. He was unsure how long the city was on generation power, but he knew staff got the generators fired up in about 45 minutes. Terry liked the written city manager reports in the packet, and would also like to see the Electric Department provide information on various projects,including moving the transformers, on a monthly basis. Casagranda asked if Merrell Brothers had been granted the necessary permits to conduct the sewage lagoon sludge removal project, Long stated the company had permits granted to dispose of the material at the landfill,and now they were waiting for permit approval for disposal at different location.That permit process was currently in the public comment period,so they would have to wait to hear on the status of that permit. Darling asked what positions were open in the city. Long knew of the Park Operations Supervisor and the Assistant Finance Director. It changed the reference to marijuana since it was now legal to use recreationally in the State of Alaska. It did not change the city's policy on its use of it, however. Staff took this opportunity to review the policy at this time as well.Long further explained that there were two policies in the city, one for the employees who needed a federally regulated commercial driver's license,and one for all employees.The all employee policy addressed testing for pre-hire and post-accident and did not have latitude in it for random testing like the federally regulated policy did. Motion (Terry/Casagranda) Amend Resolution 2015-016 by laydown: 1. Adding the following sentence to section I. A. 3. C. of the policy: "However, this policy does not preclude consuming alcohol at social or business functions where an employee is representing the City of Seward and where alcohol is served. Even at these functions, however, employees may not consume alcohol to the point of intoxication, to the point where they endanger their own safety or the safety of others, nor may they consume alcohol if they are going to drive. Butts asked about the safety sensitive positions listed in the policy and other positions not defined as safety sensitive. Long said this was a list of primary safety position in addition to those who had access to results of drug tests like himself and the Personnel Officer.He said this covered a huge portion of the employee pool. Long said drug investigations and confidential information for drug testing was considered public safety information. This was created because there was no definition earlier to a safety sensitive position. Squires asked about those who worked in the Parks and Recreation Department who worked with children and transported children in the Teen and Youth Center(TYC)vehicles. Earnhart said the positions listed were the typical safety sensitive positions.He noted the positions listed were in a position of making quick judgments and decisions. Terry added the TYC staff did drive children in vans. He congratulated Austin Chapman who won the Distinguished Service Award,Mike VanderVegt who won Firefighter of the Year, and the two Chief Awards given to John Underwood and Mike McHone. She thanked those who championed the efforts to bring the Sikuliaq to Seward. CITIZEN COMMENTS Tim McDonald stated the last time the electric utility was appraised it was worth$18 million and it could be worth more now. He was sure the appraisal on the sewage lagoon was high as well, but he wasn't sure it was high enough to put $8-10 million into it for repair. McDonald felt the reasoning to spend funds because they were grant funds shouldn't be an excuse. He wondered if the city was going in the right direction on the sewage lagoon. He spoke on the marijuana initiative passed in the state. McDonald said his research found it to be a miracle plant and 50%of medicines used to have THC contained in it. Hemp had a high quality use. This particular bond was done in 2008, and would not normally have come up so soon,but given low interest rates,the timing was good and the bond bank was favorable.Although she could not provide a specific prediction on what Net Present Value(NPV)savings this refinance would yield until the very moment of resigning, she said she wanted to be in a position of capitalizing on obtaining NPV savings if they were substantial enough. She approximated the potential savings at$394,000 which represented an 8.1%savings over the life of the bond.The bond would mature in October 2038 rather than June 2038. This refinance would reduce the annual debt service payments in the amount of approximately$30,000 per year for the Electric Fund. In response to Darling,Erchinger said one could only refinance any given bond one time in its lifetime,and that was an additional consideration she was mindful of.Long added that the federal government was planning to raise interest rates in June this year, so this was a good time to refinance. In response to Butts, Erchinger said she would consult with the city's contracted financial advisor, as well as the bond attorney, to determine whether or not to actually refinance at the moment.However,she speculated that they would recommend refinancing if there was a minimum of a 4%savings. I have served the City of Seward and its residents on the Board of Directors of Cook Inlet Aquaculture Association, the Board of Directors of PWSRCAC, and most recently the Historic Preservation Commission, where I serve as Vice-Chair, I served on many other PWSRCAC committees which are listed in my Vitae. Since the TN Exxon Valdez oil spill (EVOS) I have become very active in OSPR. Since its inception in 1991 I have served 12 years on the federal public advisory committee for the EVOS Trustee Council. I currently serve as the Science& Technical Representative, and was recently elected Vice Chair. During my previous tenure as the City of Seward's representative to PWSRCAC, I Chaired the OSPR Committee and served on the Scientific Advisory Committee. I have become a recognized subject matter expert in many aspects of OSPRR.I am the sole proprietor of Pegasus Environmental Solutions—Alaska. This is a scientific and technical services company, providing subject matter expertise to a variety of government and PNP entities. The recent publications section of my attached Curriculum Vitae cites the work products from some of these projects. This Vitae is a condensed version of my regular resume. The full version is available if you wish it. Two RCACs were mandated under the Oil Pollution Act of 1990 (OPA 90). These regional citizens' advisory councils are intended to help assure citizen and stakeholder input into the transport of crude oil within their geographic areas of responsibility. As its mission statement says PWSRCAC is citizens promoting environmentally safe operation of the Alyeska terminal and associated tankers. It does this by participating in developing regulations and oversight of terminal operations, helping build a stronger partnership between industry, government regulators, and stakeholder entities, and helping assure that the best available science and 62— technology is used to prevent oil spills and to minimize adverse impacts on natural and human resources in the event spills happen. Early in the agenda of all PWSRCAC Board meetings, all voting members have an opportunity to report on "activities since the last meeting". In 2003 when I first represented the City of Seward as a Board Member, most Board Members spent a significant part of their time discussing the activities and needs of their Member Entities. By 2013 when I decided not to ask the City of Seward to reappoint me, many Board Members were barely mentioning who they represented in their reports. Instead they reported almost exclusively on their personal activities since the last meeting. Fewer and fewer Board Members have had any direct experience with EVOS or any other large oil spills. With my knowledge and expertise into the workings and history of PWSRCAC, As the City of Seward's representative I would be well positioned help redirect the PWSRCAC Board back to a more appropriate balance of its roles as a representative Council and a PNP governing board. During my previous tenure I relied too much on the City Manager, and not enough on the City Council, to provide me direction regarding the City's activities and desired direction. If appointed I shall provide the City Council with written reports following each PWSRCAC Board meeting (January, May & September), and will give a brief verbal update to the City Council and listening public at the next meeting following submission of my written report. Besides representing the City of Seward and its harbor facilities, there are other entities within the city which deserve representation but are not represented by a specific Member Entity, these include the Alaska SeaLife Center(ASLC), Alaska's Institute of Technology (AVTEC), UAF-SFOS including the Seward Marine Center& RA/Sikuliaq, and the Alutiiq Pride Shellfish Hatchery. State and Federal land managers, including the Kenai Fjords National Park, Chugach National Forest, and Alaska State Parks all have their own PWSRCAC representation; albeit non-voting. In addition to representation as constituents of the City of Seward, business interests and Alaska Native interests are expected to be partially represented by the Alaska State Chamber of Commerce, and Chugach Alaska Corporation, respectively, both who are voting Member Entities of PWSRCAC. The benefits of home-based hospice care would greatly contribute towards the quality of life for our community members who are terminally ill, and for their family and friends. Currently, Seward does not have any hospice care, and dying residents are often left with no choice but to leave their home to live out their remaining days in a medical facility. This affects not only the terminally ill resident, but also their loved ones. Many terminally ill people want to remain close to their family and friends, in their own homes, to carry out their last days in loving comfort and peace. When Seward residents who are receiving hospice care in Anchorage choose to come back home, they risk losing continuity and oversight of their care and this can result in unnecessary suffering and additional medical expenses. Elements of home-based hospice, such as bereavement support, community education for end- of-life planning, and in-home assessment of patient needs, lead to better prepared individuals, decreased stress, and a more normal and deserving bereavement process. The City of Seward fully supports the Volunteer Hospice Program Advisory Committee in their endeavors to establish a licensed volunteer program for hospice care in Seward.
