HomeMy WebLinkAboutRes2015-049 Sponsored by: Hunt CITY OF SEWARD,ALASKA RESOLUTION 2015-049 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH M.L. FOSTER & ASSOCIATES TO PROVIDE ADDITIONAL ENGINEERING SERVICES AND CONSTRUCTION SUPPORT FOR AN AMOUNT NOT TO EXCEED $58,000 WHEREAS,M.L.Foster&Associates has provided wastewater engineering services to the City of Seward for the past 7-8 years and has extensive knowledge of our wastewater system; and WHEREAS, M.L. Foster & Associates has been providing Construction Support under a Purchase Order,and further support services will bring M.L.Foster's Construction Support cost over $50,000, which requires City Council approval; and WHEREAS,M.L.Foster&Associates engineered the Sludge Removal and Disposal project at the Spring Creek and Lowell Point Wastewater Treatment Facilities in 2014; and WHEREAS,additional construction support is needed for the Sludge Removal and Disposal project; and WHEREAS,Public Works staff requests a professional services agreement with M.L.Foster &Associates to close out the Spring Creek Sludge Removal and continue to provide construction support for the Sludge Removal and Disposal Project at Lowell point. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is hereby authorized to enter into a Professional Services agreement with M.L.Foster&Associates to complete the necessary construction support services for the Sludge Removal and Disposal project for an amount not to exceed $58,000. Section 2. The Seward City Council hereby finds it in the public interest per Seward City Code 6.10.120 (A) (8)to sole source this professional services contract. Section 3. Funding sufficient for this contract has been previously appropriated to the Sewer Lagoon Sludge Removal (SLSR) infrastructure accounts via resolutions and account numbers, respectively:Resolution 2014-066 into account no. 18321-8101,Resolution 2014-019 into account no. 18320-8101,Resolution 2012-056 into account no. 18322-8101, and Resolution 2014-080 into account no. 18323-8101. Casey Agenda Item: Authorize M.L. Foster & Associates to provide Engineering Services and Construction Support to the City of Seward. BACKGROUND &JUSTIFICATION: Currently, the City has Merrell Bros. Inc. contracted to perform sludge removal at the City's two wastewater treatment facilities. They will install additional aeration units(Bio-Domes)at the Lowell Point Wastewater Treatment Facility after inspecting and performing repairs that maybe discovered during this process. Staff originally obtained Purchase Order's for M.L. Foster's creation of the scope of work, bid documents and project management for the Sludge Removal and Disposal project. Staff was optimistic that these services would fall under $50,000. It is now apparent they will exceed the $50,000 threshold. Public Works staff has been working with the City's Project Manager to perform a majority of the tasks related to the management of the project. Between the two departments most of the day-to-day oversight can be performed in-house,providing a cost savings to the City. There are several tasks that must to be performed, documented and/or inspected by a registered engineer. City wastewater staff needs additional engineering support for these services. The Scope of Services that M.L. Foster will provide are: • Review Submittals from Contractor • Response to Contractor and City Staff Questions • Minor Design Changes (Bio-Domes) • Weekly Reports to ADEC • Record Documentation(As-Builts) • Submit to ADEC for"Approval to Operate" • On-site Observation during Bio-Dome Installation • Weekly visits, as requested(Bio-Dome placement) • Survey Work for As-Builts • Services required by ADEC • Review Contractor Pay Requests M.L.Foster bills on a time and material schedule. The rates that M.L.Foster charge are equal to,or less than, the average rates from comparable qualified wastewater engineering companies. The engineering services they have previously provided have been invaluable to the City for planning, lL5 permitting, and construction of multiple projects in the wastewater division. M.L. Foster is intimately familiar with the Seward facilities,has on hand multiple reports of Seward's WWTF's, has been working with ADEC on Seward's behalf for over 7 years and has delivered reports and assistance, professionally and in a timely manner. Having M.L. Foster continue to provide engineering services is advantageous to the City. INTENT: To enter into a Professional Services agreement with M.L.
