HomeMy WebLinkAboutRes2015-017 Sponsored by: Applicant CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2015-17 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, RECOMMENDING KENAI PENINSULA BOROUGH APPROVAL OF LOT 16A,BLOCK 9,ORIGINAL TOWNSITE OF SEWARD, SNOWDEN REPLAT,AT 209 FIFTH AVENUE WHEREAS, Integrity Surveys Inc., representing Blue Yonder LLC, has submitted a preliminary replat to the City of Seward for review and recommendation to the Kenai Peninsula Borough; and WHEREAS,the replat combines two(2)existing lots and a portion of a third lot—the south five feet of Lot 14,Lot 15 and Lot 16,Block 9,Original Townsite of Seward—into one(1)new lot described as Lot 16A; and WHEREAS, the properties of this replat are located within the Central Business Zoning District(CBD)and would create a 6,500 square foot parcel,which exceeds the minimum lot size and lot width required by City Code; and WHEREAS,the property is fronted by Fifth Avenue and is currently serviced by municipal water,sewer,electric and other utilities;therefore a subdivision installation agreement is not required for this replat. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission recommends the Kenai Peninsula Borough approve the Lot 16A,Block 9,Seward Original Townsite,Snowden Replat vacating the interior lot lines of Lots 14, 15 and 16,Block 9, Original Townsite of Seward, creating a single parcel of approximately 6,500 square feet subject to the following conditions: A. Locate and add 10 foot wide utility easement centered on existing overhead, electric service line located at the rear of the property. B. Add the standard utility easement note: "No permanent structure may be constructed or placed within a utility easement which would interfere with the ability of the Utility to use the easement." Seward Planning and Zoning Commission Resolution No. 2015-17 Page 2 of 2 C. The surveyor shall identify all existing encroachments. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 14th day of July 2015.
