HomeMy WebLinkAboutRes2015-109 Sponsored by: Hunt CITY OF SEWARD,ALASKA RESOLUTION 2015-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,RECOMMENDING THE 2016 HARBOR TARIFF BE AMENDED BY CHANGING THE WAITLIST VESSEL SIZE FOR A-FLOAT, ELIMINATING THE 17 FOOT WAITLIST ADDING A 50 TON TRAVELIFT WATER TO WATER MAINTENANCE LIFT, AND OTHER CLARIFICATIONS WHEREAS, the Seward Harbor owns and maintains a 50 ton travelift to support local vessels with haul outs for winter storage,surveys and quick maintenance repairs while hanging in the lift ; and WHEREAS,the intention of this proposed water-to-water maintenance lift charge is to assist harbor users accomplish maintenance tasks that often take less than a half(1/2) hour and can be performed safely with the vessel in the slings at a reasonable price; and WHEREAS,a new half(1/2)hour rate for this type of water-to-water lift would benefit vessel owners with quick repairs; and WHEREAS,the current charge for the 50 ton lift is one hour or TWO HUNDRED THIRTY SIX DOLLARS AND TWENTY-FIVE CENTS ($236.25)plus tax; and WHEREAS,the 50-ton water to water maintenance lift shall be charged at a rate of ONE HUNDRED EIGHTEEN DOLLARS AND THIRTEEN CENTS($118.13)for the first half(1/2)hour plus tax. All time in excess of thirty minutes shall be charged in fifteen(15)minute increments at the rate of FIFTY-NINE DOLLARS AND SIX CENTS ($59.06)per one-quarter( 1/4)hour or any portion of time less than one-quarter( 1/4)hour to stay consistent with current tariff rates; and WHEREAS, while performing the maintenance lift, if it is discovered the vessel needs to travel to a local boat yard, the current one hour minimum lift rate will apply. ; and WHEREAS,with the new configuration of S-float eliminates 17 foot slips,and therefore the need for a 17 foot waitlist. ; and WHEREAS, general housekeeping changes to the tariff are needed: Section 200(e) July 1 sr for the new twice a year renewals, and Section 245 by adding outside of,twenty four and a day for making change for the showers. WHEREAS the Public Notice preamble of the tariff states "This tariff is published and filed as required by law and is, therefore, notice to the public, shippers, consignees and carriers that the rates, rules and charges apply to all traffic for which contract rates have not been CITY OF SEWARD,ALASKA RESOLUTION 2015-109 arranged. "The purpose of the tariff then is to publish standard rates for all manner of traffic that aren't included in a negotiated contract, not to prevent or replace the Council's authority to enter into contracts for that traffic. Tariff Section 105 (b) is inconsistent however in that it simply states that the rates apply to all users, vessels and freight; therefore the exception noted in the Notice to Public should be carried forward.; and WHEREAS,All 2016 rate increases include a Consumer Price Index (CPI) adjustment. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD,ALASKA that: Strikeout—delete Bold italics=new Section 1. The City Council approve, by amending of 2016 Harbor Tariff, by adding to section 255 50-TON TRAVELIFT FEES (b) Lift Fee (5) Maintance lift- A water to water lift shall be charged at a rate of ONE HUNDRED EIGHTEEN DOLLARS AND THIRTEEN CENTS ($118.13) for the first half ('h) hour plus tax. . The City Council approve amending section 200 MOORAGE (b) of the 2016 Harbor Tariff, as follows (b) Waiting List for Reserved Slip Assignment. Due to the demand for slips on the City of Seward float system,vessels will be assigned reserved slips based on waiting lists maintained by the Harbormaster's office. Separate waiting lists shall be maintained for the following size floats: 17 feet(accommodates vessel 12 to 21 feet) 23 feet(accommodates vessel 22 to 26 feet)23 feet(accommodates vessel 19 to 26 feet) 32 feet(accommodates'vessel 27 to 36 feet) 40 feet(accommodates vessel 37 to 44 feet) 50 feet(accommodates vessel 45 to 54 feet) 60 feet (accommodates vessel 55 to 64 feet) 75 feet(accommodates vessel 65 to 79 feet) 90 feet(accommodates vessel 80 to 94 feet) 100 feet(accommodates vessel 95 to 104 feet) 105 feet or longer- side tie only-up to 150 feet Assignments to a reserved slip from the waiting lists shall be made by the Harbormaster CITY OF SEWARD,ALASKA RESOLUTION 2015-109 based on the slip size available and the most senior name on the waiting list for that size slip. Section 3. The City Council amend the 2016 Harbor Tariff with changes to wording in sections 105 (b) 200 (e) and 245 to read the following. 105 APPLICATION OF TARIFF (b)Tariff Effective. Rates, charges, rules and regulations named in this tariff and any additions,revisions,or supplements thereto shall apply to all vessels or users and to all freight received at facilities subject to this tariff on and after revisions,or supplements thereto,for which contract rates have not been arranged.Unless otherwise specified all transit freight received at terminals and undelivered prior to effective dates of tariff, revisions, or supplements thereto, shall be charged the rates in effect on the date such freight was received until entire lot or shipment has been withdrawn. 200 MOORAGE (e) New Reserved Slip Assignment. For a new reserved slip moorage agreement entered into after January 1St or July 1st, the following rules and charges apply: 245 PUBLIC SHOWERS Public showers are available twenty-four hours a day in the restroom facilities located in the Harbormaster's building. The showers are coin-operated, and the fee is TWO DOLLARS ($2.00) (eight quarters) for 7 minutes. Change is available outside of the Harbormaster's office twenty four hours a day. Section 4. All 2016 rate increases are based off CPI per.section 215 DOCKAGE RATES. (c)Automatic Annual Adjustment in Dockage Rates.All dockage rates shall be adjusted annually so as to be effective as of January 1st,to reflect the five previous published years' average increase in the Consumer Price Index, All Items, 1982-84=100 for all Urban Consumers, Anchorage, Alaska ("CPI")as published by the United States Department of Labor,Bureau of Labor Statistics.Bills sent out prior to January 1st will reflect the upcoming January 1st adjusted rates.(For example,2016 rates reflect an increase based on the average CPI for 2009-2013). BACKGROUND &JUSTIFICATION: With the new S-float configuration there are no longer 17ft slips available,the harbor had only one year round tenant in this slip catergory,which was a 19ft vessel. The minimum size vessel for A- Float is now 19 ft. The Tariff should be amended so that the new waitlist for A-float will be 19 to 26 feet, and remove the 17 foot waitlist. The Seward Harbor owns and operates a 50 ton travelift,to remove or place vessels into or out of the water for winter storage or other maintenance issues. Some maintenance issues can be accomplished in a minimal amount of time.Currently the harbor charges a 1 hour minimum fee($236.25 plus tax) for a lift. The Harbor would like to establish a water to water maintenance lift with a half hour minimum charge($118.13 plus tax)to assist harbor users at a reduced fee for minor maintenance issues,i.e.line in the prop,changing zincs or looking for damage from hitting an underwater object, etc. If the lift goes over the half(1/2) hour minimum fee it will be billed in 15 minute increments ($59.06) to stay with the current Harbor Tariff rates. This reduced fee would benefit fisherman, pleasure,sail boats and charter boat owners.If the lift has to travel to a private yard or the vessel has to get blocked up for any reason the current one hour rate would apply.
