RE: City Attorney Report for the period May 1, 2018 through May 31, 2018
Dear Mayor and City Council:
The following summarizes our activities as City Attorney during the period May 1,
2018 through May 31, 2018:
1. General Matters: In addition to providing ethics training to Council and
Board Members on May 15, 2018, the City Attorney's office provided advice and worked
on various matters, including records requests issues; contract provisions; revising
policies, including updating and revising library public use policies; land title issues; and
personnel issues. We advised on the early termination of the Vigor contract and Icicle
lease revision, and advised on union organization issues.
2. Litigation: Oral argument is scheduled in the Orion litigation for June 11,
2018, at 9:00 a.m., in the Bankruptcy Courtroom of the old federal courthouse in
Anchorage.
The Reinke personal injury lawsuit was tendered and accepted by Seward's
insurer, AML/JIA, and is being defended by insurance counsel with Holland &
Knight, LLP. The matter is in the preliminary discovery stage.
3. Organizing Activity: We were busy with union organizing related issues in
regard to both APEA and IBEW. We reached out to IBEW to discuss integration of the
field engineer and administrative assistant positions into the bargaining unit. APEA is
still organizing a bargaining committee and we will be receiving advice from Council in
executive session.
4. Hours Billed. The total number of hours billed by the firm on general
matters in May 2018 was 100.
