RESOLUTION 2004-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO NOTIFY THE
DEPARTMENT OF TRANSPORTATION TO USE SECTION 115 FUNDS
FOR THE NASH ROAD REHABILITATION PROJECT
WHEREAS, in the appropriation process in FY' 04, congress created a new unique category
of earmarks known as "section 115", granting $2,000,000 for Seward Road Improvements; and
WHEREAS, unlike previous earmarks, this specific category does not add but in fact is
deducted from the state's normal share of federal aid funding creating a shortfall for projects
programmed in the Statewide Transportation Improvement Program (STIP); and
WHEREAS, it has been determined by the Department of Transportation and Public
Facilities that the only fair mechanism for offsetting earmarks is to identify FY' 04 STIP projects to
be placed on hold within the same community; and
WHEREAS, one of the few FY' 04 projects in the Seward area not yet in construction, yet
large enough to offset some of the earmarks, is the Nash Road Rehabilitation Project which has
resulted in putting the $3.3 million construction project on hold; and
WHEREAS, in order to ensure that this high priority community transportation project
remains on schedule for FY' 04 including certain upgrades is for the City to agree to contribute it's
$2 million Seward Road Improvements section 115 earmark to the Nash Road Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It is hereby requested that DOT use the federal section 115 Seward Road
Improvements monies to complete the Nash Road Project including additional improvements
and upgrades allowing it to remain on schedule in the FY'04 STIP.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 24th day

Agenda Item: Authorize Use of Federal Section 115 Funds
For The Nash Road Rehabilitation Project
BACKGROUND & JUSTIFICATION: The Nash Road repair and resurfacing project
between mile post 0 – 5.3 was one of the 2004 City of Seward state legislative priorities.
This roadway has not received any significant repair works since the early 1980’s and is in
critical disrepair. This is the only access for a number of businesses and facilities
including Seward Ship’s Dry Dock, the city rock quarry, Spring Creek Correctional Facility
and Ocean Beauty Seafoods.
This project has been included in the FY’04 STIP with $3.3 million budgeted for
construction for later this year. We have now been advised by the Department of
Transportation and Public Facilities that $2 million earmarked by the federal government
for Seward Road Upgrades is part of a $61 million deducted from the states normal share
of federal aid funding. Consequently, DOT has determined that the only fair mechanism
for offsetting these earmarks is to identify FY’04 STIP projects to be delayed to FY’05 or
possibly later. DOT had indicated that one way to ensure that this high priority community
transportation project remains on schedule for FY’04 is to request that the earmarked $2
million be added to SFY 2004 capital budget as a supplemental request thereby allowing
this important project to remain on schedule.

FISCAL NOTE: The city is requesting council approval to authorize the use of the Federal
Seward Road Upgrade monies in the amount of $2 million to be added to the DOT Nash
Road Project. No local funds are involved in funding this project.

RECOMMENDATION:
Council approve Resolution 2004-62, authorizing the city manager to notify DOT of the
city’s approval to commit the Section 115 Federal Seward Road Improvements monies in
the amount of $2 million to the Nash Road Rehabilitation Project.
