TmEREAS a petition for the recall of Jack Jeffrey, Elsie Whitmore, A. G. HcRae and Cecil Casey from the Seward School Board was filed on June 5, 1959 with the Clerk of the City of Seward, and vfu1ffi~\S on June 22, 1959 the Clerk of the City of Seward certified as to the sufficiency of the signatures on said petition, and \~IERR~S on June 25, 1959 said petition and certification were presented to the Connnon Council of the Gity of Seward, and ~mERR~S following litigation in the Courts of the State of Alaska, Opionion No. 7 by the Supreme Court of the state of Alaska dated Septenilier 9, 1960, states that the Common Council of the City of Seward is empowered to call such recall election, and, T'iHEREAS in an effort to comply with CHAPTER 121 of SIA 1959 and Section 3.110 of the Seward Code of Ordinances, and upon the advice of the City Attorney and the City}mnager, the Clerk of the City of Seward posted on September 13,1960 and published "Notice of Election-Amended" including notice of election to determine whether or not certain members of the Seward School Board should be recalled and if recalled to elect successor(s), NOl\[ THEREFORE, BE IT RE30L'v'FD, and it is hereby resolved that the IINotice of Election-Amendedll dated September 13, 1960 shall be approved and the Clerk is hereb~r instructed to provide separ&te ballots for said recall election and to Page One r I RESOIUTION NO. 173 (Continued) 1 do all other things necessary as provided by law in cormection with said recall 2 election. 3 4 An emergency is hereby declared to exist and the rules governing the passage of 5 ordinances and resolutions are hereby suspended and this Resolution is hereby 6 given immediate effect upon its passage and approval. 7 8 Passed and approved this 16th day of September, 1960. 9 10 11 Attest: 12 13 t:Z-<lL-u .. ~ _ ~. uJ a.~ Beatrice E.
