Seward Animal Shelter project located in Seward, Alaska. Criterion is uniquely qualified to perform
this project, bringing knowledgeable key personnel, resources, and relevant experience as a full-
service general construction (GC) company. Criterion has a track record of successful projects
and satisfied owners throughout the State of Alaska since 1992. This project fits well with our
ideology-Criterion prefers projects where our input as contractors can be used to provide benefit
to the outcome of each project, regardless of whether we are the GC, part of a design-build
team, or we are low bidders on a project which has already been designed. We prefer to
collaborate with the owner and design team throughout the design development phases with
our open-book estimates. Our diverse portfolio includes commercial office buildings, financial,
educational, medical and visitor facilities as well as light industrial buildings, tenant improvements
and renovations.

capabilities to provide the best value as your GC of choice. We possess specific qualifications that

by Lumen Design.
For the lump sum of$1,978,336.00, we hereby propose to provide labor, materials, and supervision to perform the
work per the concept design and project narrative.
NOTE: With no current geotechnical report our civil numbers are based off assumptions of export and import.

DISTRICT
WHEREAS, City Council passed Resolution 2018-049 on May 29, 2018, directing City
administration to bring forward recommendations for a site on which to relocate the animal shelter;
and
WHEREAS,upon adoption of City Council Resolution 2018-049 City administration was
tasked to identify potential sites for relocation of the animal shelter; and
WHEREAS, Lot 6A-2 Fort Raymond Subdivision Replat Number Three consisting of
approximately 10.7 acres, is located at 605 Sea Lion Drive,in the Institutional Zoning District; and
WHEREAS,Lot 6A-2 is owned by the City of Seward and currently supports a number of
public uses including a baseball field, the electric utility warehouse and substation, and two
municipal water wells; and
WHEREAS, Lot 6A-2 is served by electric, water, and sewer utilities; and
WHEREAS, Animal Shelters are currently an allowed use in the Industrial and Resource
Management Zoning Districts per Table 15.10.226 Land Uses Allowed; and
WHEREAS,the Alice Pickett Memorial Animal Shelter is a public facility operated for the
well-being of the animal companions of the citizens of Seward and is operated by the City of
Seward; and
WHEREAS, the Institutional Zoning District is designed to allow public and private
educational. administrative, government and health care uses, including public land reserve for
future public development. The development standards are intended to set a high standard to
assure that the activities provide visual amenity to the surrounding area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA THAT:
Section 1. The Seward City Council hereby supports the Alice Pickett Memorial Animal
Shelter be relocated to Lot 6A-2 Fort Raymond Subdivision Replat Number Three, located at 605

BACKGROUND &JUSTIFICATION:
The Seward City Council has recognized for many years, the need to relocate the Seward Animal.
Shelter away from the adjacent residential neighborhood and off of prime City property, as identified
for many years in the City's Capital Improvement Plans and Local and State Legislative Priorities
Lists (attached). Recently, various ,groups have demonstrated grassroots advocacy and planning
efforts, and have developed donations to support construction of a new shelter, through fundraising
efforts.
The Community Development Department has been working to identify potential sites which could
free up the existing site of the animal shelter for resale as a high-value property for residential
development, helping to offset the cost of the relocation effort.
Based on analysis of lot size, location, and proximity to utilities, the Community Development
department has selected Lot 6A-2 Fart Raymond Subdivision Replat Number Three, Located at 605
Sea Lion Avenue as the most desirable location for a new animal shelter.
On September 4, 2018 the Seward Planning and Zoning Commission approved Resolution 2018-015
recommending that the Alice Pickett Memorial Animal Shelter be relocated to lot 6A-2 Fort
Raymond subdivision replat number three, located at 605 sea lion avenue, within the Institutional
(INS)zoning district
SUBDIVISION REVIEW:
Zoning:
Lot 6A-2 is located within the Institutional (INS) Zoning District. The Institutional Zoning District is
designed to allow public and private educational, administrative, government and health care uses,
including public land reserve for future public development. The development standards are
intended to set a high standard to assure that the activities provide visual amenity to the
surrounding area

Animal shelters are currently not an allowed use in Institutional (INS) Zoning District, per Table
15.10.226 Land Uses Allowed. The animal shelter is a public facility operated by the City of Seward
for the health and welfare of citizens and our animal companions. Staff recommends that the
Planning and Zoning Commission approve a forthcoming land use table amendment allowing the
operation of an animal shelter as an outright use within the Institutional (INS) Zoning District.
Utilities:
The property is currently served by water, sewer, and electric utilities. There is a 25 foot utility
easement along the north property line that intersects existing electrical, water, and sewer utilities
and runs directly adjacent to the proposed building site for the new animal shelter. The Public Works
and Electric Departments will make determinations on the best and most cost- effective way to
extend services to the proposed building.
Size:
Lot 6A-2 consists of approximately 10.7 acres.
Fxxisting Use
Lot 6A-2 is owned by the City of Seward. A number of public uses exist on this property, including a
baseball field, two municipal water wells, and the electric utility warehouse, substation, and backup
generators.
Flood Zane:
According to the FEMA Flood Insurance Rate Map, Lot 6A-2 is located entirely in flood zone X,
outside the special flood hazard area.

Mark Luttrell,outside city, along with Jane Belovarac, and Christiana Smith, came to the podium
to speak on behalf of SOS Pets in support of Resolution 2018-01 S. Lutrell stated that they were
pleased with the proposed location of the animal shelter. Luttrell stated that he has spoken with three
school teachers who are enthusiastic about the potential of bringing school programs to the shelter.
Belovarac stated that an added bonus to locating the shelter close to the high school is that in the
event of an emergency, evacuees sheltering at the high school may be able to utilize the animal
shelter and be within walking distance of their pets.

Wilde stated that in selecting the proposed site for the relocation of the animal shelter, planning staff
has taken into consideration the public input received at the August 7, 2018 P&Z meeting, and
looked for City land that was away from neighborhoods. Wilde and Bacon conducted a site visit to
Lot 6A-2 to take measurements, and then researched current uses and easements on the property. It
was determined that a 4000 square foot area of flat ground, unencumbered by easements, existed on a
portion of the Lot off Sea Lion Avenue. A map has been included in the packet and is on display on.
the wall showing the possible site of the new shelter. Wilde discussed potential access points for the
building that will be detenmined as the site planning process moves forward. Wilde told everyone
that currently animal shelters are not allowed in the Institutional Zoning District, and if the
Commission passes this resolution then Planning staff will bring forward an ordinance change to
modify the land uses allowed table. Wilde stated that the Community Development department has
received multiple phone calls in support of this location for the new animal shelter.

The city manager shall present to the council a budget proposal for the next fiscal year of the
city at least 45 days prior to the next fiscal year. Such budget proposal shall set forth the city
manager's recommended tax rate based on an analysis of the anticipated income and expenditures
of the city during the next fiscal year. The proposed expenditures set forth in the budget proposal
shall not exceed the expected revenues of the city. Unencumbered funds remaining at the end of the

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, ADOPTING THE CITY OF SEWARD STRATEGIC PLAN
WHEREAS, the City of Seward Strategic Plan was prepared by the City Council,
Planning and Zoning Commission, and the administration in October, 1998 from public input
provided at the two town meetings held on September 29, and October 1, 1998; and
WHEREAS, the purpose of the Strategic Plan is to identify the community's vision of
Seward in the year 2020 and provide the City of Seward with direction for accomplishing that
vision, and
WHEREAS, the Plan includes specific goals and objectives that will guide the City
government in its decision-making over the next five years to help reach the community's vision
of Seward for the year 2020; and
WHEREAS, in order to ensure that the Strategic Plan accurately reflected the
community's vision, and that the goals and objectives were consistent with the vision, a public
comment period was held from December 21, 1998 to January 29, 1999; and
WHEREAS, the Planning and Zoning Commission reviewed the public comments,
amended the plan, and approved Resolution No, 9-03 recommending City Council approval of
the Strategic Plan; and

donations,the community has demonstrated a willingness to help fund construction of a replacement
animal shelter,with continued fundraising efforts underway; and
WHEREAS, the administration has identified potential sites to the south of Dieckgraeff
Road which,if used for this project,could free up the existing site of the animal shelter for resale as
a high-value property for residential development,helping to offset the cost of the relocation effort;
and
WHEREAS,the Seward City Council supports the concept of the administration developing
and bringing back to Council, a cooperative agreement between the City and an as yet unidentified
party willing to spearhead efforts to relocate and construct a new animal shelter to be owned by the
City; and
WHEREAS,under the terms of a proposed cooperative agreement,the City Council would
support in concept, appropriation of the cost of the project for reimbursement for actual direct
expenses incurred related to construction of the new animal shelter; and
WHEREAS,the contract provides that City employees may volunteer their time to operate
City-owned equipment at no charge to assist in some aspects of the project, if that is determined to
be in the best interests of developing a cost-effective project; and
WHEREAS, it is in the public interest to encourage the use of volunteer services and labor
to provide a lower-cost means to construct an animal shelter; and
WHEREAS,because the Kenai Peninsula Borough does not manage animal control efforts
in the area surrounding Seward City limits, it is not uncommon for the local animal shelter to be
adversely impacted by the lack of Borough shelter and,therefore, some impacts to the shelter come
from residents inside the entire Seward utility service area. The Seward Electric Utility will
contribute 2017 credits towards the animal shelter.

NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD,ALASKA that:
Section 1. The administration is hereby authorized and directed to bring forward to Council,
recommendations for a site on which to relocate the animal shelter.
Section 2. The City Manager is hereby authorized to seek a local partnership with an
organization with the means and capacity to coordinate the animal shelter relocation efforts, with
said shelter to be located on City property.
Section 3. The City Council hereby supports the concept that City employees be authorized
to volunteer their time during off-duty hours to assist in project development and construction using
City-owned equipment and tools, only if and as authorized by their department head and the city
manager.
Section 4. Initial start-up funds in the total amount of$167,922.50 are hereby appropriated
as follows: 1)$29,450.02 from Animal Shelter Donations collected to-date;2)$741.75 from 2017
Animal Shelter Fees; 3) $45,372 from 2017 State revenue sharing funds in excess of budget; 4)
$23,710.73 from 2017 surplus credit for Bradley Lake;and 5)$68,648.00 from 2017 CEA patronage
credit,for a total amount of$92,358.73 from account no. 15000-0-3710-80015 and$75,563.77 from
account no.01000-0-3710-80015 to the Animal Shelter Relocation Fund account no. 80015-0-3700-
01000 and 80015-0-3700-15000.
Section 5. This resolution shall take effect immediately upon passage.

Agenda Item: Creation of Animal Shelter Relocation Fund and Start-up Funding
BACKGROUND & JUSTIFICATION:
`rhe Seward City Council has recognized for many years, the need to relocate the Seward Animal
Shelter away from the adjacent residential neighborhood and off ofprime City property,as identified
for many years in the City's Capital Improvement Plans and Local and State Legislative Priorities
Lists. Recently, various groups have demonstrated grassroots advocacy and planning efforts, and
have developed donations to support construction of a new shelter, through fundraising efforts.
The community development department has been working to identift,potential sites to the south of
❑ieckgraeff Road which, if used for this project,could free up the existing site of the animal shelter
for resale as a high-value property for residential development, helping to offset the cost of the
relocation effort. The administration would like to investigate the possibility of identifying a non-
profit organization in the community which may be willing to spearhead efforts to relocate and
construct a new animal shelter to be owned by the City. A report will be provided to the City
Council as to whether or not there is interest expressed by local organizations, to serve in that
capacity.
Under the terms of a proposed cooperative agreement, the City Council may be asked to support in
concept,appropriating funds for the project in a reimbursable direct cost methodology,similar to the
process the City used to construct one of the softball fields in the past. Should such a contract be
developed, administration asks Council endorse the concept of City employees volunteering their
off-duty time to operate City-owned equipment at no charge to assist in some aspects of the project if
that is determined to be in the best interests of developing a cost-effective project.
The Kenai Peninsula Borough does not manage animal control efforts in the area surrounding
Sc\y .ard City limits, and it is not uncommon for the local animal shelter to he adversely impacted by
the lack of Borough shelter. For that reason, it seems appropriate that funding for the project could
come, in part, from revenues related to the entire Seward utility service area

FISCAL NOTE:
Initial funding for this project would come from donations already received, in addition to animal
shelter revenues. One-time State revenue sharing funding in 2017 exceeded budget by$45,372 and
could therefore be used for this one-time capital project. Capital credits from Bradley Lake and
Chugach Electric in the amount of$92,358.73 could also be made available.
